Application Under Simplified Processing!!!

Dear expert,

Need a help for my friend's case.

He applied under Simplified process in December 2007, its taking long time and he is curious to know is there any possibility to apply under new category? He assessed and his spouse is under the list of those occupation of Minister.

Whats your suggestions about him?

she should apply if she has 67 points for sure. it also depends on how long it will take from their country for the old application.
Do they want to risk it incase the rules change due to the economy?

I didn't get your point Rupesh,

I meant that if she applies under new category, will it affect to their previous application? From Pakistan it takes 3-4 years for simplified in which they had already applied, He just wanted to know that what if he apply in new category? Because his spouse points are 67.

i read somewhere that on the forum where the person said that CIC is not clear about what people with existing applicaitons should do.Lets wait for someone else to answer or you could search the forum for that post.

Hi, there is no clear info regarding if you can apply again withought witdrawing the old one. The only official statement is this:

my opinion

you can't have two applications in process for PR at the same time

both the principal applicant and his wife are regarded as "applicants" in the initial SAP application

you must withdraw this application in order for the wife to file a new one

CIC will know if you try to "cheat" the system

Actually you can have as many applications in the system as you want. Read the following OP bulletin.

"8) Can applicants have both a pre-C-50 FSW application and a C-50 application?

Yes, applicants may have multiple FSW applications. The applicant can choose to either maintain the first application and submit a new C-50 application with a new processing fee; or withdraw the first application and submit a C-50 application. If an applicant chooses to withdraw their pre-C-50 application before processing begins, they will receive a refund.

Missions should inform applicants that they cannot advise whether the original FSW application or the C-50 application will be a faster process. Missions should avoid recommending a particular course of action to applicants.

Thank you very much for the official statement from the CIC regarding this. I believe many people are in this situation. Is C-50 the bill which includes the ministerial instructions?

So, should spouse of my friend apply under new process? Hope its not a negative or effective process to his previous application.

Can you please guide if application is submitted this way, what will be next? Will they proceed this one on priority? what will happened to previous application?

i think pre-c50 fsw wil pre feb 2008 application
C50 are post feb 2008

C50 is ministerial instruction.
