Dear all,

Today I got a letter from CPP-O that they reject my application. I apply under PhD stream and the officer rejects my application because he/she does not feel that I fulfill the one-year work experience under Section 75(2).

My work experience is as follow:

Job 1:
Research and Teaching experience (4012): from Sep 2007-Apr 2008 (447.2 hours)

Job 2: Human Resource Professional (1121): from May 2008 to Aug 2008 (577.5 hours; this was my ONLY FULL TIME experience)

Job 3: Research and Teaching experience (4012): from Sep 2008-Apr 2012 (1245.4 hours)

Job 4: Research experience (4012): from Sep 2008-Apr 2012 (340 hours)

Job 5: Research experience (4012) (or regarded as Health Policy Researcher (4165)): from Jun 2011-July 2012 (In this job I work as a research coordinator, conduct research and write academic paper outside university setting)
(1155 hours)

My application was rejected because none of this working experience alone reaches one-year full-time or part-time equivalent work experience. In addition, the officer comments that my LAST Research experience (Job 5) from Jun 2011-July 2012 does not fulfill the code of 4012.

However, from my understanding, as long as you obtain full-time plus part-time continuously in ONE OR MORE occupations, you fulfill the one-year continuous work experience. Has CIC changed their rules? Or, can't I combine full-time experience (Job 2) with part-time experience together?

I just do not understand how CIC makes their decision. Any suggestions will be useful.

I applied in Aug 2012 (before the new immigration system), and I am trying to find the RA letter that they reject. In the meanwhile, what I really do not understand is that, from the other positions (Job 1 - 4), they should add up to one-year full time experience, even though they are made up of two codes (1121 - Human Resource Professional and 4012 - University Research and Teaching Assistant). What is wrong with that? Below is the Subsection 75(2) of the law forwarded in my rejection letter:

Subsection 75(2) of the Immigration and Refugee Protection Regulations states that a foreign national is a skilled worker if:

a) within ten years preceding the date of their application for a permanent resident visa, they have at least one year of continuous full-time employment (37.5 hours/week) experience, or the equivalent in continuous part-time employment in one or more occupations (I personally underlined and bold this, as it says one or more OCCUPATIONS, not jobs), other than a restricted occupation, that are listed in Skill Type 0 Management Occupations or Skill Levels A or B of the National Occupational Classification matrix;

b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification; and

c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.

The tracker shows you already got your visa :). Congrat. BTW, did they ever ask for the CV/List of publications/PhD. information?

Hi guys,

I just saw that the processing time has increased to 25 months. Is this the total time it takes to get PR visa if everything goes well? I am in my 2.5 years in phd but from Quebec. From what I read here the officer needs the proof for staying out of quebec, unless it is close to graduation or already living in another city out of quebec. with 13 months processing time I was thinking of delaying my application but now with 25 month I think by then I should be already finish my phd and moved out of quebec. Do you think with this new processing time I can buy more time if I apply now?

Yes, they did a mistake in my IELTS score calculation.

They accepted my updated letter and the one in google doc is my updated letter which I had added the lead statement.

Thanks man, do you know if they had any problems with your original letter? for example, did SL put any notes in your CAIPS shows that they were not going to accept it?

I got rejected while I had already sent them my updated reference letter. They had simply forgot to consider my updated letter as it was not even added to my file. After getting rejected, I just sent them an e-mail asking them why the officer did not consider my updated letter. After 2-3 weeks, I got the response saying that they never received the updated letter! I was told if I cannot prove that their office received the updated letter before their date of final decision, the final decision would remain valid. Fortunately, I could prove my case, and the person who took care of my case was a responsible one.

Just wanted to let you know in case it might help you.
