I'm not an expert on this, but I think his refugee claim will be denied. I think there's a law in Canada and the USA that says you can't apply for asylum in one when coming from the other. He would have had to make his claim in Canada.

I found this: http://www.avvo.com/legal-answers/can-usa-access-the-immigration-status-in-canada-of-870733.html It seems that if he has legal status in a third country (Canada), he is no longer eligible for asylum in the US. Why would he be? He has already settled in a country from which he needs no 'rescuing.' He will have to prove that he is not a landed immigrant in Canada, which will be hard to do since he is.

There is a difference between 'residence' and 'asylum.' I didn't see anyone badmouthing Cubans. Why are you so angry?

As I understand it, whichever country you get to first (Canada or US), you must apply for refugee status there before trying the other. Husband of OP never applied for refugee status in Canada, so he should not be succesful in the US. There are exceptions but Cuba isn't one of them.

like i said it doesnt matter where you applied for asylum residence citizenship,if you are a cuban citizen and come to the usa border they will grant you refugee status and residence,thanks to this country who really knows what happens in Cuba,not like the blind canadians who think cubans are happy with the sun and beaches(beaches that we cubans have no right to come to)
whoever erased my comments before is a stupid.

My husband is Mexican and he received his passport back last Friday, we have been together 4.5 years and the commitment and effort this takes is so substantial, I can't imagine your pain. I hope that karma bites him in the ass and that you find the someone you deserve as you must be a wonderful woman to be so loyal and dedicated.
