I am not sure about my eligibility. Could any one take a look?

I received work permit as IT worker (thus, without LMO) last September. My plan was to submit FSW application this October as soon as I have one year work experience and residential history in Canada.

The abrupt change in FSW eligibility really confuses me in its definition in arranged employment:

It describes two categories, but to me it seems that i fit neither:
1) If you are currently working in Canada: - your work permit must have been confirmed by Human Resources and Social Development Canada (HRSDC) through a positive labour market opinion

- Definitely I don't have LMO confirmed work permit.

2) In all other cases: You must not be working in Canada and you either
* do not have a valid work permit or
* you have a work permit, but your circumstances are different from those described in the first example.

- This is ambiguous too. Apparently I've been working in Canada but it says at the beginning that 'You MUST not be working in Canada'!
Interestingly and logically, it also suggests the existence of a type of people who 'have a work permit' and 'must not be working in Canada'!

Any ideas or interpretations are welcomed. Thanks in advance.
