Hi All,

Myself, my wife and our 2 Yr old son, had landed in Canada last year in Sep-2008 and then had to return back due to some unavoidable circumstances. We have already got our PR cards and SIN cards. Right now, our question to the forum is that we are expecting our second baby in the third quarter of 2009 and are concerned how to process his/her application so that he/she goes back to canada along with us, sometime next year.

Pls. advise.

As Canadian PRs living outside Canada, your baby will not have Canadian citizenship at birth like s/he would if born in Canada, or if born overseas to a Canadian citizen. So s/he would have to be sponsored for permanent residence. That means that one of you will have to come back to Canada to file the sponsorship, and stay in Canada in order to remain an eligible sponsor. There is no guarantee the baby would be allowed to come to Canada with the rest of the family without PR status.

If you can manage it at all, you'd be better off with the child being born in Canada. There are residency requirements you need to satisfy - remember - that could get messed up waiting for a dependent child sponsorship to be approved, depending on how long the partner staying overseas with the baby has already been outside Canada.
