I was nervous too. Your appeal wait was about 5 mos longer than ours. I had traveled 5 times since refusal. Staying at least one month, as long as 4 mos. Not only did we address all refusal reasons. Such as, age, culture & religious differences. But we answer to the flat out ridiculousness the vo put in her French notes. She had no reason to lie. We asked for English too. Anyhow evidence was presented first. Then my lawyer asks some key questions. Both the ministers counsel & judge can ask clerifications at any time. Then they both cross examine. We only had 3 hours. A morning slot. But we only needed 2 hours to win. Go over questions with your husband as well. They ask where I go to school. What our highest education level is. Our plan if we lose. To keep fighting to live together in Canada. My family, friends and 23 yr career are all in Saskatchewan. Our best chance for successful marriage and life is there. Oh yeah also we were going to use an interpreter. But we change our minds. Good thing as Arabic from Lebanon is not even close to Moroccan. The judge told asked the mc his thoughts. He said he is willing to set aside the refusal. And the judge declared she was in complete agreement. So we were told right then. And also got our letter 2 weeks later. Our file is in Ottawa.
Am sure you'll do fine.

If you already sent in new evidence according to the rules (8.5x11, numbered consecutively, with table of contents, etc.) to both IAD and CBSA, there is no need to send it again. For any additional evidence you want to send in before the hearing, start numbering from where you had previously left off. If you want to make sure, you can probably call the IAD number and ask.

Sorry to hear about your baby. I know it can be devastating. Hopefully you were able to be together with your wife to help her through the ordeal.

I just saw this on Twitter. From the Vancouver Western IAD. This could be good for some but not for others. I just copy the news. I didn't see anyone else mention it so I thought I would give a heads up.
Reduced Capacity at the Immigration Appeal Division, Western Region
At this time, the Immigration Appeal Division (IAD) of the Immigration and Refugee Board of Canada has reduced capacity to conduct oral hearings from its Vancouver and Calgary offices. This is because the mandates of a number of Governor-in-Council–appointed decision-makers have come to an end.

The IAD will do its utmost to maintain its operations, but will be able to schedule only a limited number of oral hearings in its Western Region (west of Ontario) for at least the next six months.

In the interim, in an attempt to minimize the impact on appellants and counsel, the IAD will focus its efforts on resolving as many appeals as it can without an oral hearing, making maximum use of its early informal resolution initiatives, including the Alternative Dispute Resolution process.

The IAD recognizes the importance of timely processing and appreciates the difficulties this situation will cause for those affected. The IAD is committed to informing those appearing before the Division of any further developments that could affect the scheduling of pending appeals.

It is the standard paper size in North America, also called Letter Size. 8.5" x 11" In our case, we use A4 size, which is a little narrower, and a little longer than Letter Size, so documents had to be reduced to fit on the acceptable paper for submission. Look for the Disclosure of Documents Checklist, which should have been included with your Acknowledgement of Appeal.

Relax, it sounds like you are very well prepared. In addition to all the additional evidence that you've sent in, you will have a full day to make your case. It's okay to be a bit nervous though, it means that you are taking this seriously.

Witnesses can be helpful, by either appearing in person, of by way of affidavit. Hopefully your photos, etc. includes members of both families, friends, etc. through different periods of your relationship.

Current applicants are asked to send in maximum of 20 photos and 10 pages of correspondence, yet most of them go through without an problem. It looks like you've exceeded that many-fold. Make sure you (your lawyer) have indexed the important parts of your disclosure so that you'd be able to locate the pertinent parts quickly and easily.

Someone posted here recently that the Minister's Counsel was so overwhelmed by their evidence that they called off the hearing, as it was no longer necessary. If that happens with you as well, please let us know. maybe it's a new trend. Which city is your hearing scheduled for?

Good luck.
My hearing is in Toronto.

I do believe we will do fine MaryL, because who knows a relationship better than the two people in it. Immigration just knows what we filled out in our sponsorship application and whatever else evidence we've sent in. We have discussed and prepared to answer all questions for the reasons we were refused.

You and your hubby should try to know everything about each other and also depends on why they denied your hubby, you should try to provide enough evidence proving them wrong.

For example if they denied him because they think your relationship is not genuine, you need to prove that it is real by showing them that you are going to spend time with your hubby, you need to show them all of your call and chat records...phone bills, skype, whatsapp, bbm etc. In the mean time you are waiting for your hearing date, you should try to visit your spouse as much as possible, talk, text throughout the day, let your messages show that you are involved in one another's life, write letters, send cards, when you visit your spouse go to different places, take lots of pictures every time you go out and when you are at home, the more the better.
i did that all..and during his interview he gave them over 400 pages of proof and it was tossed aside for nothing...

Although I go out all my heart to support you, but based on your description here regarding your husband's interview, I guess you guys messed up by yourselves. Your case may have some red flags, such as age difference, religious background difference, culture difference, and etc., plus your wedding is out of the culture normal, thus, your husband was required an interview to have him to convince the VO your marriage is genuine. And yes, the VO has every right to ask those "Sexual" questions within certain boundaries, such as how often, position, the color of your favorite underwear, and etc., those questions are nothing about to disrespect you, whatsoever. If you do your home work, you will know all those questions are on their questionnaire lists. Obviously, "This is not a good question" won't fly to the VO.
We are both Muslim and had the traditional Moroccan wedding. There is an age difference. I didn't know that they could ask sexual questions. Good to know. Where can I find the questionnaire list?
