Hi everyone,

My wife has been working in Canada for almost three years under a post graduate open work permit now after graduating from Seneca College. We just recently had gotten married and are in the process of gathering the documents required for her PR application.

In the meantime, her open work permit is expiring on August 17 of this year. Would she be eligible for the BOWP? Or should she be applying for a regular open work permit to receive an extension?

We're planning to submit both the PR application and an extension for her open work permit together. I'm just not sure which open work permit should she be applying for

No - she will not qualify for a bridging open work permit. BOWPs are only available to those applying for PR through economic immigration streams.

She can apply for an open work permit (OWP) if you sponsor her for PR through the inland spousal sponsorship process. The OWP has to be submitted along with the complete inland application package and the entire package needs to reach IRCC before her current work permit expires in order for her to be able to continue working without disruption.

Note that you will not be apply for an extension to her work permit. You will be applying for a new OWP.

Once we submit her owp app would she be okay working under implied status until a decision is made on the owp?

We're under a bit of a tight timeline unfortunately

As long as the application reaches IRCC before her current work permit expires - then yes, she can continue working. Note that if the PR or OWP application are incomplete in any way that results in them being returned, she will lose implied status and have to stop working. Make sure you review all forms and payments carefully before submitting.

Actually that's great to know thank you! So we're in a bit of a pickle as the reason we're waiting to submit the PR app is because of a police certificate we need from Japan. Apparently according to the Japanese embassy, it takes about 3-4 months to receive and with the covid situation it may take longer.

We were thinking of going ahead and submitting the PR application sooner and providing an explanation to the officers stating why the police certificate isn't included in the package. Also her biometrics won't be in the package due to the service Canada temporary closures But if the PR application is sent back asking for the police certificate, would she have to stop working?
