Hi,
I am out of status since September 29,2016 I stayed in Canada because I'm waiting for my HC application and it was refused, I found an employer and applied me for a LAMIA and work permit but it was refused as well, my agent told me to go back home and promised me that they would apply me for another Lamia and send it to me.
*** My question is if ever they applied me for a new LAMIA and it will be approve and I will apply for a work permit back home, do you think immigration will approve my application even if I stayed here for almost a year with no valid papers?

Please help me thank you

It's hard to say. The fact you remained in Canada for a year without status and also applied for H&C will likely work against you at least someone. Work permits are sometimes refused if CIC believes you don't have sufficient ties to your home country and have intentions to remain in Canada long term. You've already demonstrated that you want to live in Canada long term (through the H&C application) and also overstayed your visit. My recommendation would be that you return to your home country and live there for 12 months to re-establish ties BEFORE you try applying for a work permit. If you apply as soon as you return home, I think the chances of refusal are very high.

After a year and I decided to re apply what are my chances of getting an approve work permit? Will it be 100% sure that I can get an approve lamia and work permit?

It's never 100%. I don't think it's possible for any of us to say what the chances are.

Your employee might received LMIA, but 99% your working visa will refused, because you over stay with no status. LMIA is from your employer side, and working visa is from your side.
