working while PGWP in process (ineligible)

HI all, my friend is in a little bit of a pickle.

She applied for a PGWP unknowingly that she ineligible for one. She got a letter from IRCC stating that she can work while her PGWP is in process, which she did.

What would be the implications? Since the letter does say she can keep working, would she get into any legal trouble?

Nothing since she filed for a fake PGWP. Once refused she stops working and is out of status.

I'm on a study permit and planning to apply for a visitor visa (visitor record?) to take a break from studying before applying for a new study permit.

My current study permit expires on Dec 5,2025, and I will apply for visitor status before it expires. How would I go about applying for the new study permit while being a visitor? Do I apply with Outside Canada option? I've heard there're exception where I can applied with Inside Canada option while being a visitor.

Visitor visa and visitor record are not the same thing. Visitor record lets you stay in Canada. Visitor visa lets you leave Canada and return.

if you change status to visitor then your application for study permit is processed from home country. You then have to justify costs and show that you will leave Canada. Applying as a visitor is risky because showing you are not leaving Canada. If approved you have to leave Canada to get it stamped. Do you have a TRV?

You have studied in Canada so you need to justify why you must stay in Canada (program is one of a kind, cannot be taken elsewhere). Yes, you need to justify costs with career progression when you return home so program must be related to education too. You are applying as a visitor in Canada so have no ties to return home if your study permit expired 3 years ago. You aren't eligible for PGWP so why study in Canada. To IRCC, you don't want to leave so you need to explain it. You are not an inland application if a visitor.

Masters or PhD may have an easier time.

Filing a fake PGWP and working is fairly uncommon but may also be interpreted as filing a PGWP in bad faith to be able to work for a longer period of time. Given PGWP processing times this is not a good idea and IRCC could technically take action against her. IRCC is no longer the lax organization it used to be. Consult a lawyer.

Given the processing times for PGWP and IRCC looking for reasons to remove people think this is now a risky plan. Would probably consult a lawyer but if someone has any desire to remain in Canada would personally not suggest misrepresentation.

I meant study permit application. I entered Canada in 2017 as a student, I've been kicked out of 2 colleges for lack of attendance (please don't yell at me, I got into marijuana), before finishing a diploma as an HCA at a college in a few months. I was surprised that they even gave me a study permit given my past at the time. I had 3 months of authorized break at my current college.
