Hi All,

I would like to know if I am on PR ,and working from India for a Canadian company ,getting Salary in Canadian account.
I will be present in Canada for say 3-4 months in a year ,then when doing PR renewal whether my working from India can be
considered as exception scenario for physical presence requirement.

Do you guys see any issues with PR card renewal?

It will be tough. CIC takes a pretty strict view regarding this. If you are working for the (Canadian) federal government or deployed abroad working for Canadian military, then yes. If it is a Canadian company, it depends on if you were first working for the company in Canada first and then they moved your position abroad, then it may be possible. If you applied for the position knowing it is abroad, then it will not be accepted. If your are incorporated (self-employed) and move yourself abroad, then of course they will not accept this.

Now if you are married to a Canadian citizen and your spouse goes abroad to live with you, then that is no problem regardless of your employment.

Actually I am already working for the company ,and will be getting PR in 15-20 days or so,but after that I want to work for 6-8 months in a year from India due to some issues and most probably company will allow that....

so in that case you see any issues..?

Can you settle your problem in next three years, if you can then after three years you can come and live here for another two years to renew your PR card (if rules remain same).

Yes - you should expect issues. CIC won't allow you to count your days outside of Canada as days inside of Canada.

In order to count days outside of Canada towards residency, you would first have to accept a job that's located in Canada full time. After working this job for a while, the company would then have to transfer you to a permanent position outside of Canada.

If you are already in a job that is located outside of Canada then CIC won't let you count this time towards your residency obligation.

There is a big difference between requesting your Canadian employer if your can work remotely from abroad vs if your Canadian employer transfers you abroad and you are *required* to be abroad to do you job. The former will most certainly be rejected by CIC while the latter *may* be accepted as days towards your PR RO.

As HHH2000 mentioned, you can still meet the 2 out of 5 year minimum anyway regardless if you are out of the country up to ~7 months a year.

This will be an easy decision for CIC to make - it has bounced written all over it. As advised start off working in Canada then get assigned on a full time basis abroad in a bonafide position not for a job arranged for you to dodge the RO. Is your employer listed on the TSX or any other major G7 exchange...if not that is usually a sign not to bother. What's the turn over of the company? How many employees in Canada? How many in India? Has it reported profits for all of its operational life in Canada? Are you a part owner of the company etc. CIC knew PRs would be lining up to play the system so this is one area of the RO where they up their game.

PR card not receive yet, wanted to go home

Hi guys,

I had my confirmation last month (Aug 16) and I haven't receive my PR card yet and i need to go back to my home country. I am planning to ask my daughter to send me.my PR card once it arrives.. is it legal to do that? Or should i just get a travel document
coming back?

Pls i need answer asap..thanks

Almost impossible to get anyone to sponsor anyone who is outside Canada for any job unless they have unique skills not available in Canada which might be rare in the IT field. Try looking through the immigration website to see if you qualify for immigration http://www.cic.gc.ca/english/immigrate/eligibility.asp
