Work permit question

Good morning All,

My husband and I applied for spousal sponsorship within Canada back in March 2013. 2 days ago we received separate letters from CIC. My letter stated I was approved to sponsor my husband and my husband's letter stated he was meet the requirements to be sponsored for PR. It mentioned he would have to do his medical etc. His letter also mentioned he was now apply to apply for a work permit.

2 questions - #1 in regards to the medical, should we just go to a CIC appointed doctor and get the medical done, or will CIC tell us when its time to get it done? #2 regarding applying for a work permit, which form would apply in this case for us to complete? I've searched all over CIC website and its really hard to find the form we should be using.

Hi,

Regarding question #1:

Since you have been approved as the sponsor (which from my understanding is the longer of the two stages required for overall approval), I think you should now schedule for medical with an approved `panel physician'.

Question #2:
Had your husband included the OWP (Open Work Permit) application with your sponsorship application back in March of this year, he would have received it at this stage. Once the sponsor is approved, and has received the AIP (Approval In Principle), the OWP is usually approved and issued as well.

I believe that the correct form would be IMM5710E, but please wait until someone with more experience here can confirm this.

Congratulations for your stage 1 (of 2) approval! Hopefully, you'll have stage 2 within 8 months.

when you do file for the OWP, can I suggest you use the online option. The processing time for that is 18 days - its 54 if you send threw the mail.
You will have to do the medical first, as a forum from the is attached to your OWP application as well as 2 immigration (not passport) sized photos. The cost is $150
You can just google "apply for work permit Canada" and it will take you to the page. From there you would select the temporary worker option, because until "landed" you would be under that category.

I am filling out an online questionnaire that gives us a questionnaire number after it determines if you qualify to apply for the permit or not (even though the letter said we can go ahead and apply) anyhow, its asking my husband's current immigration status in Canada, none of the options apply to my husband. The options are: student, works, visitor, temporary permit holder, refugee or live in caretaker. I don't know which options because none of them apply to my husband ???

Is he here as a visitor? Most of us came in as visitors, though some were on work or study permits. He's not a PR yet, so if he came in as a visitor, that's still what he is.

he came on a work visa which as since expired.

How long ago did it expire? Since you didn't submit OWP with his app, he is currently out of status. He should have applied to change from a work permit to a visitor visa before his work permit expired. I don't know anything about restoration of status at this point. Hopefully, someone more knowledgeable will read and help.
