Hi, I had applied for PR in Oct 2020, FSWO, US resident. No movement in the PR application. My spouse has moved to Canada and I am eligible for spouse open work permit. I have also secured a job offer and my employer has just completed the 1 month LMIA process.

What is the fastest route for getting work permit - employer WP or SOWP? Is one preferred over the other? Please advise @legalfalcon

Also, can anyone please share any recent work permit timelines if applied from US.

The processing time is the same. The only benefit of getting an employer WP is that it will not depend on the status of your spouse's WP, i.e. the SOWP is only issued as long as your spouse has a visa.

However, SOWP is an open work permit and allows you to work for any employer, whereas as an employer WP ties you to that employer. But it allows you the flexibility that if your spouse's visa is running out, your spouse can apply for a SOPW based on your WP.

Evaluate each option and see what best works for you.

What type of industry do you work in? If your job is considered highly specialized and where there is a shortage of workers in Canada your application can be considered under GSS. Processing times are much faster in that case. Still likely over a month but much faster than normal WP.
