Hi All,
From last 3 and half years I am working as a Postdoctoral Fellow and now my boss has no more funding for me to continue so my closed work permit is going to end in another few days and meanwhile I applied for permanent residency in Feb 2011 and my file was transferred Originally from Buffalo to Ottawa in June 2012 and on 24th April my file has been transferred from CPP, Ottawa to Port of Spain for quick processing. Now the problem is I am facing hard time to find a new job without PR status and my work permit will expires at the end of May 2013, so what best I should?
1. I should leave country?
2. Can I stay legally until I get my PR approval after my work permit expires?
I donot know how to solve this situation.
Please help me out if any one of you have any idea.

Thank you
Naidu

If you want to stay after your work permit expires then you will have to apply to convert your status to visitor.

1. You do not have to leave the country, if you apply to extend your status(i.e. change conditions) as a visitor before your current work permit expires. This will give you implied status and you can stay legally until CIC makes a decision on your visitor visa application. Note that visitors are not permitted to work. More info. here: http://www.cic.gc.ca/english/information/applications/visitor.asp

If CIC rejects it(hope not), then you still have 90 days from date of refusal decision(letter) to restore your status. More info. here, under "Restoration of status": http://www.cic.gc.ca/english/information/applications/guides/5551ETOC.asp#restoration

2. You can stay legally IF you apply and obtain extension of your status each time until your PR application is approved.

3. Have you looked into the bridging open work permit?
More information here: http://www.cic.gc.ca/english/department/media/notices/2012-12-17.asp

Bridging Open WP – Eligibility Parameters

To be eligible for a bridging open WP, the following parameters must be met:
•The foreign national is currently in Canada;
•They have valid status on a WP that is due to expire within 4 months;
•They have received a positive eligibility decision on their PR application under one of the Economic Class programs above; and
•They have made application for an open WP.

The "positive eligibility decision" is the AOR(acknowledgement of receipt) which you get by letter or email from your visa office. It usually has your file number(starts with B or E) and sometimes includes instructions for medicals.

Check your emails and any letters you have received so far to see if you have this AOR. You would have to apply for it before the current work permit expires.

Thank you for the information, I will try for Bridging open work permit....
Thanks

Ok. But you don't say whether you have received your AOR?

I received my AOR number in March 2011.
Based on your suggestion, today I applied for getting open work permit, I hope I am now legally allowed to to stay in Canada after my present work permit expires.
Thank you. Your advice is highly appreciated

That's good then. You will have implied status when the current permit expires and can stay legally until CIC makes a decision on your work permit application.
