Hi All,

I have an offer from an IT company in Canada and they are planning to start the LMO process soon.

My question is can I work for the company in my home country while the LMO process is in progress.

I have already resigned from my current employer.

Its an immediate requirement, it has to be filled in 2 weeks.

For Ex: If the Canada work needs to start from September 1st.

Can I work for the Canada company, I wanted to understand from the legal side. Am I allowed to work since I wont have any work permit during LMO process. How will I be paid .
 
No, you are not allowed to work in Canada without a valid Work Permit

I'm sorry for the confusion.- Not work inside Canada. I understand you need a work permit to work inside Canada.

Work outside Canada -work in India for the Canada company during the LMO process. is this allowed.

In my opinion, you will have to negotiate it with the company in India ;)
 
I had never been in such a situation, so cannot say much :)
 
I mean that it is hard for me to say about your situation... because it depends on your future employment contract in a Canadian company, the period of employment... just cannot advise you anything, sorry.

Which employer payrolls your salary will run on. Future Canadian employer? You need to submit those as proof of your employment while applying for work permit. I just doubt how would visa officer take that.

I think answer is No. your cannot work. But if anyone has done in this way, I would be glad to hear.

Yes you can.
 
Exactly the same as PMM said, Work permit is a requirement to work in Canada. There is no law preventing any one from working remotely for any one any where in the world. They just have to find legal means to pay you which should not be a big deal.

However, i think you might be questioned by visa office latter that if you could work remotely, why do you need to go there physically ultimately. At least some proof that it might fly for some time but not on a permanent basis.

I am glad i could be of help.

I have worked free lance for some time as well. Although it is different when you are a full time employee, it is a pretty common practice nowadays to hire remote candidates at least in IT. There are tons of companies in the US which do so on a regular basis. Even many of them post jobs on hackernews and similar forums on a regular basis.

In fact i was considering one such position before coming here as well.
