Hi.
My husband and I are applying outland, we sent our application on october 20, already got AOR2 from VO and we were asked for more information including police certificate which we already sent. So basically we are just waiting for what would be the last steps I think.
The situation that worries me a little bit is:
When we were preparing our application, I had all my papers and info gathered together on august 2014 and I sent it to husband n Canada, on my questionaries I signed date august. We filled information as common-law. My husband wasn´t ready with his part until october, mainly waiting on his tax form. When he got everything ready he finally sent our application on october 2014.
The situation is that when he came to visit me in september, we got married, exactly on september 12th. He went back to Canada and sent our application as if we were still common law, because, honestly, we had all ready, questionaries filled and didn´t want to change everything, and all papers were already in Canada. Plus waiting on the marriage certificate to be legalized, translated, sent to Canada would have made us wait at least two more months.
We thought it would be easier to apply as common law and just update immigration and tell them we already got married.

So my question is if you think this could raise some issues or questions from immigration about authenticity or they will ask why we got married in september and then applied in october as common law and not spouse?

Will this might be considered misrepresentation? We already let them know about this and as I mentioned at the beginning, we have sent all documentation requested and this update on the relationship (marriage certificate) to the VO but I am a little bit worried.

I'm a bit confused here, becuase you talk about sending documents back and forth. Can you please explain how you came to be common-law?

I am sorry for not explaining myself correctly.
We have been living together continuously for one year in Toronto and three years in MexCity, then my husband went back to canada on january 2013, that´s why we applied as common law.

Basically, your husband `back dated' his signature on all of his forms, correct?

I won't go so far as to say that it could be seen as misrepresentation, but I do think that you need to inform CIC that you are now married. CIC won't be able to prove that the forms weren't actually signed in August, which may be the thing that saves you in this case...but it was pretty careless, IMHO.

Also, it's possible that at least one of the forms had been updated by CIC between the date that was signed on the form and when CIC actually received your application in October 2014. You should check the CIC website ASAP to make sure they have not updated anything!

I know that the Application to Sponsor form (IMM 1344) WAS updated in August 2014, so hopefully you DID include that version.

I think they would have already asked us for updated forms if these were not the current ones, as I mentioned I have already been contacted from VO for additional information that included police certificate and updated version of Schedule A (IMM 5669).
We have also already informed CIC about the change of our marital status.

I have a hunch if they had any concerns regarding the common law or the outdated forms you would have heard about it before getting SA.

I agree with BigredMoose,
If they haven't been concerned so far, then there is nothing to be concerned about. However you absolutely MUST inform CIC of the change in status (you're married now). They provided the information of where to send it in in you sponsor approval letter.

That should have redone the forms though. yes, they suck, but the minor changes (and simpler forms) would have been less stressful in the long-run.

If you've infrmed them of the change in status, they already have the marriage certificate and they can do the math. They would have stopped you by now if they saw it as an issue
