Will my Permanent Residency be conditional?

Hello,

My wife and I are applying outland for myself to become a PR but I know that if you are married for less than two years the Permanent residency is conditional and you must stay in the relationship for two additional years.

Will my PR be conditional in our scenario, which is;

We have lived together for three years but only have been married for 6 months. Do the consider us "conjugal" for the duration of us living together and therefore my PR won't be conditional?

Any ideas on this?

Condition applies if the couple does not have any children in common and
has been married for two years or less;
dated for four years, but has been married for two years or less;
has been in a conjugal relationship for two years or less;
has cohabited in a common-law Footnote 1 relationship for two years or less; or
has been in a common-law or conjugal relationship for more than two years and has been married for less than two years, and the person submitted an application as a spouse.
It sounds like you would get the condition. However, CIC has been known to be inconsistent on this. It's not really a big deal either way, it won't affect any of your rights as a PR.

Is there a reason why you are concerned with this?

IF you are in a genuine and loving relationship than this Condition means Nothing.....it really is No Big deal Unless, you are Not in a genuine relationship and feel like you Must stay married for two long years in order to not get your PR revoked. Is there a reason why you are asking....

Conditional would be if u are married or common law but u have no kids together.. and in any case, i don't think u should be worried if its going to be conditional or not.

If the marriage is genuine and you are willing to spend the rest of your life together then whatever PR condition CIC issues doesnt matter....

As for conjugal you don't qualify as you are married. As for condition 51 its a hit and miss with CIC.

I would agree to have 10 years of conditional PR, but just reduce waiting time to get it :)

For me people who worry about this condition in advance is a bit "fishy", nothing personal for post author, but I am just curious, why is it really so important, it doesn't affect you if relationship genuine. Maybe I don't know something and this condition have some effects in the future?

It can possibly cause problems if one spouse will need to live apart for some time due to work or school. Technically there is no exemption for that in condition 51 rules.

So this condition means that you need to LIVE or to STAY with your partner? As I still don't get how it can be an issue if you are in genuine relationship.

Its about living with your partner. If one was to get a job on a cruise ship for instance and was apart for months at a time this could possible affect the condition 51

Well I was thinking more along the lines of truck driver..or commercial airline employment but since
the OP has not let us know more information, we really can't know.
He may live in a border city and wants to keep his job across the border on the American side..
in which case, the condition would not be affected since he would be home every night...

In any case, he will still be getting the condition.

Now I am more confused, so if I decide to work in the cruise or as a truck driver, technically I can jeopardize my PR? As I won't be home every night?
Or is it about your residence address?
I am just quite curious what is the purpose of this condition then and is it fair that you are not allowed to support your family with some jobs? :)

Yep, you have to live with your partner. If you were living on a cruise ship away from your partner you are not cohabiting. If CIC found out and chose to do something about it, you could lose PR.
