Will my application be refused or returned over this?

My husband didn't send a copy of his expired passport which expired in 2011, just the new one he got this year.

If the application or checklists didn't ask for a photocopy of his expired passports, you're ok.

It did not, it only said valid travel document..

Don't let second-guessing yourself eat you up. If you sent everything that CIC requested in the guides, checklists, and applications, you're good to go!

While the check list didn't ask for expired passports, it does ask for copies of bio pages passport covering 6 years prior to submitting application. This would include expired passports if they fall within the 6 year period.

I don't know which checklist you're referring to. OP applied Inland I believe, and I applied Outland. I haven't studied the Inland checklists as thoroughly. That's why I worded my response appropriately.
