Hi

Im working in canada on temporary work permit since June-2008 in IT filed . Initailly i got my work permit from 15/06/2008 to 16/12/2008 . And in Nov-2008 i applied for work permit extension . But i got the work permitt on 16/01/2009 for another one year .
So there is gap between the old work permitt expiry date and new work permitt extension date .

So i recently applied for FSW under temporary category(living in canada since one year) . And i got the first level approval and sending the all documents to buffalo office very soon .

But my lawyer is telling that buffalo visa officer will see one continuous full year pas work permit rather than two six months work permit with one month gap . But during that one month gap , i was working in canada .

So will it affect my second level processing . please let me know

i guess the requirement is one year continuous employment. not one year continuous work permit. work permits get expired and have to be extended, this makes sense. as long as you are getting your work permit extended before the first one is expired, and keeping your employment continuous, this should be fine. but you said there's a gap between your two work permits. this is tricky and depends how immigration officer see this. keep us posted as we would also like to know what happens with your case. good luck.
 
I think you should not have problems as long as you had complied with the conditions stated in this CIC link.

Your original temporary status as a worker continues under the same conditions until your application is finalized and you have been notified of the decision."
