Hi All,

We got our PR stamped in the month of May valid till April 2016. Now my situation changed where we are expecting a baby arount feb 2016.
till then only i can travel to Canada to complete my landing. My wife wouldn't be able to travel due to pregnancy complications until she deliver the baby.

Now my questions is what is the option i have?

Option 1: Inform CIC about the change of situation and get my PR cancelled. wait until baby delivered and apply for baby PR application. submit all our passport again?

Option 2: I will land first become Permanent Resident. then sponser both my wife and children?

Option 3: I will land first become permanent Resident. My wife will land after she deliver the baby (we are expecting the baby in the month of feb 2016, visa valid until april 2016). then we submit sponsership application for kid?

Please let me know what is the correct way to move forward.

Thanks !!

Option 1, is definitely an option. You can discuss it with the visa office. You do however take the risk that if your wife or baby have medical complications and fail to pass medicals for the new PR visa's, you will all be excluded and none of you becomes a PR. Some members of this forum were also recently told that because their visas had been issued, their files were closed and if they did not land, they would have to apply again from scratch. Now, this is not really true but if the visa office were to feel that way, you have a problem.

Option 2, as long as you land before the baby is born, you can do that. Once the baby is born, your visa automatically becomes invalid due to change in family composition and if you still land on it without having added the baby to your application, you would be guilty of misrepresentation and you would be barred from ever sponsoring your baby so better not do that. I know of a case where a man landed while his pregnant wife stayed at home and after the baby, they asked to add the baby to their file and issue a new visa for the wife and this was done so you could try that. If immigration refuses to do that, you could still sponsor them. You would however have to stay in Canada during the processing time of the sponsorship and so you might be separated from your family for some time.

Option 3, would not work because once the baby is born if your wife hasn't landed yet, her visa will automatically have become invalid due to change in family composition so she would have to either ask for a new visa included the baby on her records which basically means added the baby to your file or you would have to sponsor them both.
