which package do I use

Hello,
I am a pr and my two children live with me in Canada, while my wife is still working in another country. I returned to Canada to re-establish myself after an absence and fulfill my residency requirements and my children came with me and live here now with no legal status. I would like to now sponsor my wife and children, but one package is for sponsoring family outside of the country and another is for sponsoring family inside the country. Which do I use?

If you sponsor her inland she has to remain in Canada during the whole process (probably 2 years) and with Outland she can remain in her country working, and still visit . This process is usually faster.

Thankyou, but what about the children? I have to sponsor the children as well, and they are in Canada, can they be on the outland application even if they are here with me?

Agreed, but this would not solve the issue of the children being out of status, which is a problem for an Outland application.

I hope I'm wrong about this, but if your children cannot get legal status, they may have to go to where your wife is living, while your Outland application is being processed.

I have been PR for many years. I was married out of the country and my children lived with my wife and I maintained my residency requirements to maintain my status. So, I was PR before I had my children. On the GIC website they say this:

You can apply to sponsor your spouse, common-law or conjugal partner, or dependent children to immigrate to Canada. It does not matter if they live in or outside Canada. If they live in Canada, they do not need to have legal status to be sponsored

So, its a bit confusing. The kids are from a visa exempt country so per say they aren't illegal, but they are not PR. They do leave when they have to (every six months) but they have been going to school here, which apparently is also not illegal as long as I am PR.

Your first post made it sound like your children were here without status, but...they do have status...visitor status, right?

This actually makes it easier for you! And, I'm happy to hear that your marriage and children came after your PR. That could have been a tragic error as some people do not declare their spouse or children on their PR applications and are then heartbroken to learn that they can NEVER sponsor them...and may potentially lose their own PR for misrepresentation!!

As Graihn suggested, file an Outland application and apply for a visitor extension for your children. You can ask for 12 months and you might get it, which you may have to extend a second time, based on the estimated processing times for your wife's country. It would be helpful to have the application submitted before requesting the visitor extensions. There are no guarantees that your extension(s) will be approved, but being from a visa exempt country certainly increases the odds in your favor.

An Inland application would force your wife to return to Canada and remain in Canada for the duration of the process. If, however, the procesing times of your wife and children's country are much longer than 16 months (estimated time it takes for an Inland application to be completed), an Inland application is worth considering.

Are your children not from the same country as your wife?

Is she from a non-visa exempt country?

If so, this sounds like it could be rather tricky and you should wait for a senior member here to offer their advice.

How long was your absence from Canada? Do you currently meet the residency obligation or have enough time before your PR card expires to meet the RO?

If you do, then you are fine to submit the sponsorship app as soon as you can.

If you don't, i.e. you were out of Canada for 4 years and have only been back in for 1 year, you shouldn't sponsor your family. You risk the VO realizing you don't meet the RO; you would be reported and most likely lose your PR status.
