We are able to send off our in-land Spousal PR application and Open Work Permit application in about a week but I'm curious about implied status. My wife's student visa expires on April 30, 2017 so I'm curious as to whether implied status is given once the application is received by CIC or is it given the date the application has been post-dated by the post office is sent off? I just want to ensure she's still in the country legally after the student visa expires.

She will be on Implied Status after her study permit expires and before the OWP is issued.

This assumes she is still in school full time. If she stopped attending school at some point - the answer may be different.

Yes, it does assume that.

Thank you to you both for the clarification. Truly appreciate it.

Her school did finish on February 1, 2017 so she won't be in school in-between the time the study permit expires and waiting for the OWP. Should we foresee any issues? She is going to be doing her own self-study at home during this time and keeping herself busy at home.

She should apply for a post graduate work permit! Then she won't need to get by on implied status and will be free to travel if needed.

That's fine. It's really only a potential issue when a person drops out of school.

Having a PGWP does not make a person free to travel.

Great, thank you so much for the advice canuck_in_uk! You've put my mind in ease.
