Hi guys,

My common law partner previously sponsored his first wife almost 10 years ago when they started their application. She only received her landed PR August 2014. Due to some problems, they decided to get a divorce in July 2018 which has passed 3 years ban.
My partner and I filed our application in early October 2018 ( when his status was still divorce pending) and he only got the divorce certificate after he submitted the application.
Anyone has the same situation? What should we expect from CIC and would our application be longer than their 1-year estimate time?

I’m also waiting for my work permit. Not sure if I should continue going under express entry since I have 433 now. With the wp I can probably increase my points by working.

Please share and thanks very much!

Why would you submit an application while the divorce was still pending? Your partner was still technically married at that point.

Being married to someone doesn't prevent a common law application from being successfully processed. As long as you can prove the relationship no longer exists (should be easy in this case since divorce papers have been filed), the common law application can certainly be approved.

Divorce is one thing, you can be with someone else if you are separated from your previous spouse.

Do you have any experience as to how CIC observe our application and relationship? We submitted only photos, letters of friends and family, utility account with our names, join bank account, lease agreement. No text messages or phone record tho
