Hello all.

As a backgrounder: Inland app under spousal with OWP AOR filed June 30, 2014 ,received Aug7 on Implied status

Just this morning, I had a death in the family and I want to go home.
I need your input coz this is what im planning to do:
1. Go to MP ask for help.
2. Go to Immig office in our place and ask if they could give me some kind of emergency visa
3. Apply for Tourist Visa while im in Canada
4. Cancel Inland app and apply outland

>>>If we cancel Inland, does my spouse have to cancel it like make a letter of explanation? We havent got a SA yet, is it still possible to cancel it? Will all of our application forms and proofs, pics, be returned to us?

Thank u in advance. I just dont know what my options are

I saw your post earlier saying your son was in hospital. Died? Oh my god. I am sorry to hear that.

Please try MP and immigration as well.

Oh my gosh I'm so sorry to hear. I would imagine that CIC would give you some leeway here and allow you to return for some time without having to jeopardize your application.

It's the CBSA that would need to be sympathetic.

My condolences to this member for such a tragic loss.

Pretty horrible situation, really sorry you are in going through this. I have no advise either but I do suggest you maybe start a new thread with a different heading maybe "death in family, Inland application can I leave?". It might grab the attention of someone who can help that might not otherwise look at this thread.
 
Sorry to hear about your loss of your son.

As for travelling outside Canada while inland application is in process, you should be able to re-enter Canada as long as your current TRV is valid. Risk of being denied re-entry is there but if you explain your situation to CBSA at re-entry, you may be able to get back in as you do have valid cause for leaving Canada during inland.

However if your current visa is expired and currently under "implied status" then you have no choice but to cancel the inland application and resubmit a new outland PR application. The moment you leave Canada, your "implied status" disappeared and you will not be able to re-enter Canada at all, no matter what the reason may be. The airlines will not even allow you to re-board the plane to Canada.

Given that you mentioned about applying for TRV within Canada, I'm assuming your current visa has expired and you are under "implied status". Applying for TRV within Canada cannot be done. It can only be done outside Canada.

In light of your situation, my advice is to cancel the inland application and redo the application outland. Unfortunately, being married or common law with your partner will make your application for TRV next to impossible to get. You may need to consider moving back to your country and wait it out until your outland PR application is completed. At least the outland is currently way faster than the inland approach.

Pretty much agree with screech.

1) Your MP can't help, like screech said "it's the airlines that won't let you on the plane".
2) CIC will say, "you don't require a visa to go home". Returning to Canada at that point will not be an emergency, to them.
3) As stated, you can do this only from outside Canada.
4) THIS IS YOUR ONLY REAL OPTION.

This is yet another example of the whole Implied Status doesn't work and the fact that you cant leave the country.
 
That's because it "works" (as it has for many) if you don't leave the country.

One of the rules of inland application is that you must remain in Canada during the entire process. The "implied status" gives and covers everyone who applies inland and benefits tremendously to those whose visa expired while waiting to land as PR. If the "implied status" is not granted, what's the point of applying inland. You might as well drop the "inland" application and stick with "outland" only.
