Hi all,

I want to ask what is my chance of getting my student visa approved, and my situation is a little bit complicated.

I've been in the U.S. for several years, from F-1 student to H1b, then 3 years ago I applied for asylum due to some threats (but my case was forever pending), than two years later I married my partner ( a U.S. citizen). This year my father had a major heart surgery, and my home country's situation is slightly better, so I withdrew my asylum case and came back to see my father. My American spouse is trying to sponsor a green card for me but the interview is in the long future, and during this time I also created a Express Entry profile and put myself in...I wasn't thinking truly will I get anything but I just did it with my friend.

My partner is going to do PhD in a mid-west state, I want to do PhD as well, so I'm applying for few programs in Canada and U.S. this winter.

I am just curious that if I got an offer from a Canadian university for PhD, what is the chance of getting my student visa approved? I feel like my withdrew asylum case definitely makes it difficult, and my age is close to 30. Will my marriage affect the chance?

Also what if I also apply for Master programs in Canada? I already had a Master in the U.S., I'm thinking if I cannot get into the PhD program then I'm willing to take another Master first then apply for PhD again. Will my chance of getting a Master program smaller than a PhD program?

Thanks.

The withdrawn asylum case in the US will likely mean it won't be possible for you to obtain a study permit to Canada. You can certainly apply and see what happens. You'll need to demonstrate very strong ties to your home country to be approved.
