CIC has requested my notice of assessment for 2010. in 2010 i started working from june till end of the year but didn't claim my income. even though i have my one year experience in 2011 with full tax paid and 2012 too. i am just curious if i am in trouble because of that ???

yes i have PGWP and applied for CEC but my lawyer said he will explain to them that i my boss didn't give me my T4 for that year and i didn't know that i should have claimed even without T4

Why not fix it now? File a T1 adjustment and correct your records. Trust me, CRA already knows of any discrepancies since they receive copies of your T4s. Don't wait for them to come after you because it may be at a very bad time for you if/when they choose to come knocking.

Sorry, I know I didn't swear your actual question because I don't know if CIC will mind. It will at the very least raise a red flag that you are claiming to have worked and earned an income, but you signed documents with CRA stating that you had no income. :-X

So, let me get this straight. You were employed from 2010-2012 (possibly even to the present) by the same employer. You did not get a T4 for 2010, but you did for the subsequent years, and filed your tax return from 2011 on. Is that correct?

It's fine for your lawyer to explain it that way, but you (or he) should also explain what you're doing to correct the situation (filing a late return).
 
exactly same employer, from mid of 2010 till now and in the letter of experience it says from june 2010 till march 2012.
i submitted my T4 and notice of assessment for 2011.
Right now they requested T4 and notice of assessment for 2010 too. the problem i don't have T4 for that year and didn't claim income for those 6 months i worked in 2010. they give 30 days to provide these documents.

Contact CRA. They should be able to provide you with the missing T4 for 2010. Then file a T1-ADJ to correct th tax return. Then let you lawyer submit the explanation with a copy of the NOA and maybe a copy of the T1-ADJ form that you have sent to CRA.

Question: is there any chance the employer did not declare you as an employee in 2910?
 
i think so because he put me on payroll starting beginning 2011, so he was not paying any tax on me in 2010. but the problem the letter of experience says from june 2010. My lawyer has requested me to get from my boss a letter confirming that i started working in june 2010 and stating the reason why my boss didnt put me on payroll in 2010. but my lawyer didn't tell me to reclaim my income again, anyways i will tell him about that..

I'm assuming the OP did not file any return for 2010 - in that case, it's not an adjustment but a new (late) return.

But if the OP did file a 2010 return that excluded that income, then yes, an adjustment would need to be filed.

Were you technically "self-employed" for 2010? If so, you should have received a T4A and filed taxes anyway...
 
Very strange situation !

1) Were you doing any work that may cause issues before you received your PGWP?
2) Is there anything on the FIRST NOA that suggests it's a first return? If so - maybe they are wondering why it's your first return when you have been working for someone prior to this period??
3) Did the employer give you a ref letter saying you worked for him from June 2010 and were in full time work etc etc?
 
I am not one to judge, but it seems that there may have been something "under the table" going on in 2010. I may be wrong, I may be right. It sounds like taxes were filed but the OP made no reference to his/her income.
I would recommend doing your best to fix whatever mistakes were made in the past, and to be careful of any declarations/affidavits you sign going forward.

I second this. If you can get a proper T4 for previous years I believe you can do sort of amended/delayed tax filing to fix previous years' omissions/mistakes. It's tax time so do that as quickly as possible and hopefully you'll get the assessment soon enough to send it over to CIC. Might need to explain and ask them for an extension. This is good for both the application and getting a clean slate on your taxes moving forward.
