Hey everyone, we are in the midst of outland family sponsorship, I have been approved to sponsor my husband and are just waiting onto stage 2 with London being our VO...seems there are alot of delays and have moved the wait times from 7 months to 8 months. we are getting to the point that we just wanna get out of Ireland and get on with things back in Canada...if we wanted to book flights and land before PR are there any factors we should consider? any advice would be appreciated thanks!!!

Since you are from a visa exempt country, you can visit Canada any time but can not move permanently (can not take all of your stuff with you). if immigration officer at the port of entry got any doubt about your intention, s/he will deny your entry. i mean to say, you need to prove that you are just visiting Canada not moving.

Is that the same even if Im a canadian and im sponsoring my EU husband??

Yeah same for all. Although they are more likely to let in a EU citizen or somebody from the States. That however is absolutely by no means a given. You are rolling the dice moving before COPR, something I am considering if COPR is not issued before late October.

On a side note. I visited Canada over the summer, whilst my Application was in process (I had just gone on to stage 2) and the border official never requested any documents whatsoever. I just said I have PR in process and he waved me through.

Yes. You can't "LAND" before you receive your COPR. You can visit, meaning your husband can visit, but if an immigration officer at your port of entry thinks he is going to stay before he is approved as a permanent resident, he can be denied entry. He can come with you to "visit", but don't try to bring anything more than your normal allowed baggage suitable for a "vacation". He will need a return ticket, and proof that he intends to return home, has ties to his home country etc. to prove to the immigration officer at the airport that he is only visiting, even though your intent may be otherwise. My suggestion would be to wait until his permanent residency is complete before you try to move back just to avoid any unpleasantries at the airport such as your husband being refused entry.
 
Hey thanks everyone for your advice and feedback!!! were really hoping for some good news soon but seems there are huge delays in London VO since the olympics >:( Does anyone know if once we have 2nd stage approval, and papers in hand do we still need to wait for PR card to arrive or can we just show them paperwork and have the card delivered to an address in Canada so we dont have to wait for another 4 weeks??

The PR card currently takes around 10 weeks to be created and sent to you - however this process doesn't start until after you have landed and become a PR. So you won't have your PR card before you land.
 
also - about moving before the COPR - quite a few people have done it without troubles. you should avoid looking like you are moving permanently, but since you are canadian, you can return to Canada with your belongings, and settling in Canada. For your husband, it is advisable to have the copy of the sponsorship approval, to show that the process is on going, and either a return ticket, or copy of your bank account showing funds sufficient to buy one...it's always up to the border officer to decide to let your husband in the country or not, but i doubt that he will be denied... especially if he says that he is coming for a long visit.
some people also reported declaring at the border that they are coming in the country to wait for their PR to come through, and being allowed in without trouble. Try and search for "dual intent" on the forum and you can read more about it.
that's what I intend to do -my partner has been approved to sponsor me, but the PR has not come through yet (same timeline as you more or less), and I'm flying to Canada on the 15th of october, with or without PR.
i think it's important that when crossing the border you make it clear that you are aware of the rules, and that your husband is coming as a visitor and will stay the lenght of his visa, and leave the country if asked to leave - but once in the country you can also request an extension of his tourist visa online - so the PR will come through probably without him having to return to Ireland.

Hey thanks so much Scylla and Sweden, great advice...we have decided to try and wait it out til end of oct to mid nov and if we still havent heard anything, we may take the chance and just book flights...will keep ya posted!! Good luck to you Sweden, please let me know how it all goes :)
 
Just out of curiosity, what if you do not mention to the immigration officer that there is PR in process, do they know that anyway when checking passports? Does that info show up on their computers?
