My OPT expires in 09/08 and I lost the H1B lottery. I am applying for my Canadian PR. If I return to my home country before getting Visa, what will happen? If I apply in India, it will take more than 5 years. Please somebody in the forum help me know about which option will be better- apply here and return to India vis a vis apply there in India. Help!!
 
You can apply now while your in the US. The only problem is when you return in India and CIC requires you to have an interview, you need to have a way to return in the US because the interview will be in Buffalo, NY where US application will be filed.

Also, who will receive the letter from CIC if you return to India? Your correspondence should all be address in the US since you filed it in Buffalo, NY.

Will there be any chances of interview being waived? How do we know about it? If I go back to India, can't I use address of some relatives of mine? Please help me understand it more. If I apply in India, it will take 4-5 years.

Hi rjn2000

There is no way to know if the interview will be waived or not, but certainly the way that you filled your application increases the probability to get it...such as... work experience, language, adaptability…, in other words the heaviest background the more chances to get the interview waived. But still, you never know
