Hello again! I keep going back and forth believing my case is straight forward and isnt. I know being divorced, having children involved, age religious or cultural differences make it less straight forward. Are there other major or minor red flags? My husband is the Canadian sponsor who lived illegally in the US for ten years. He even has an order of removal from the US when he was a minor. Huge mess. And he has no tax record and even dropped his last name in the US so most of our proofs only show his second middle name as his last name. But he is the sponsor. My side is fine, I have lived in the US all my life. Can the sponsor or any of those examples above cause complications? He has been living in Canada since April with his real last name of course.
 
Any thoughts?

i mean once you apply i think that you'll quickly know what's to come....once the application is sent usually within the first month you'll get to know if the sponsor(your husband) is illegible to sponsor....

The whole thing has much more to do with you , then with him. To some degree they do not care what he has done with his life, as long as he is not a criminal or has been on wealth fare. He has the right to be in Canada and to sponsors you since he is Canadian.. they can't really "punish" him for all that happend, or you consequently... They evaluate the sponsor to make sure that person will be able to support the person their are sponsoring, but from there, it's all about them analyzing you and make sure you want to be in canada for the right reason, and that they are not leting in a person that could a potential threat to Canada

There might be a few complication starting off, but once he'll get approved as a sponsor, you should not worry. That's my two cents...but maybe you should ask an lawyer if it helps you be more calm. This is your future with him after all. See this an investement.
 
Thank you and no I have not applied yet! I am sending my application in Jan or Feb, waiting on my marriage certificate and saving up the money. Indeed my husband has a horrible time with the US. I am hoping that works in our favor if the IO sees that Canada is really our only option considering my husbands messy relationship with the US right now. Another issue is he worked in the US but we are still unsure about mentiong that on his background form since they were under the table jobs by friends with businesses so we dont want to get them in trouble. I know I do not want a lawyer to handle my case entirely but you are right about a consultation. Hopefully I gain some confidence too!

saralune (above) is correct in that your husband has the right to sponsor you as long as he is not living on welfare and is having NO criminal record. In all circumstances, he needs to submit the triad of : medical check, background security check and criminla record. His certificate of criminal record has to cover the past 10 years of his life. So, to say, you can not avoid the fact he had been in USA. He needs the FBI clearance from USA. If you twist the matters and lie you will be in trouble. This is because it takes 20 lies to cover one lie. The best thing is to come clean and say the truth. You need a lawyer opinion. You don't necessarily need a lawyer to prepare and send your sponsorship application. This forum and similars can help you a lot in this aspect. But you need a good lawyer consultation for the best presentation of your husband's messy past in USA.Good luck
 
He needs medical security and all that?? Where is that info? I suddenly feel more lost than before. The sponsoring spouse needs all that??

Hahaha mitamata you should have seen my reaction in real life!!! Oh boy wow. Thank you for the quick follow up response. Its already complicated with his blank history. But the important thing is he was never convicted or in any debt. He was refused entry back into the US thus why he is back in Canada. Once sponsorship is approved I will feel infinitely better hehe!

Apology, I was confused. However, I do feel there is still something about him that needs some clarification. He has to be approved for sponsorship though
 
Definitely halifax-maple. I may have to take your advice and consult a lawyer although Im a little weary because of money or lack thereof really. Any advice on whether or not we should list his previous cash jobs in the us? We would hate if they were called by cic though putting them on the spot. I think everything else well i HOPE everything else can be summed up in a letter.
 
This is definitely not a straightforward case. I suggest you consult an immigration lawyer or consultant for advice. One that helps with sticky interview questions would be a good idea.
 
I suppose a sponsor having no proof of his past is tricky. I hope I can come up with the money for a consultant! I was hoping that since he is the sponsor it wouldnt matter as much. Oh well, what can you do i guess!
 
I should also note that while his past nonexistance in the us is rough we have a lot of proof and pictures and letters, we lived together in the US with family and friends for two years and had a genuine wedding and honeymoon. Consultations run for a couple hundred dollars, correct? Should I look for one in Canada or the US? Thank you again, everyone. My husband and I wish it werent this complicated on his end. Unfortunately his mother did not understand immigration laws and assumed too much and sadly here we are.
 
I plan on consulting David Cohen, founder of this website. Hopefully he can shed some light where needed! Thank you all for your insight and help. It is always appreciated! Any other guidence is always helpful. At least I have a plan though, yay!
 
I am in a some what situation but it is my husband I am sposoring and he is also in the Usa illegally.

We have listed all his employers(legal and illegal, based on the lawyer's recommendation). We also got freind to write letter who are just liek him illegal in the USA.
Canada Immigration will not go after thses people it is none of their business...

you should find a canadian lawyer who is familiar with canadian immigration policies.
