Hello,

Someone who has crossed irregular border was given and eligibility interview time in ~6 months from now. I want to know the steps they should take to become a PR. It would be nice if you can respond inline any of the questions below that you know:

1- Their status is a Refugee Claimant now and will become a Protected Person after their eligibility interview?
2- At eligibility review, do they need a lawyer? is that the court where a person becomes an accepted refugee? or no just an RCMP officer?
3- When can they apply for PR? after eligibility interview?
4- Is PR application process done online and is same like any other PR application or requires a court presence?
5- Can a refugee transfer their eligibility interview from Quebec to Toronto?
6- When can a refugee obtain a travel document? And do they need to first apply to their country's embassy for passport and only if get rejected to apply for TRD?
7- When is the refugee passport given back to them? It was taken from them at irregular border entry.
8- What programs are available to refugees (financial or otherwise) other than Ontario Works (welfare)
9- When can a refugee apply for work permit?
10- Can a refugee or Protected Person apply to bring parents and siblings to Canada? or that falls under regular sponsorship only which is lottery for parents?
11- When should Basic of Claim file be submitted and can it be submitted online or just mail? If mail, to what address?

I'll help with one question and will leave the rest to individuals who are more experience than me with the refugee claim process.

Bringing parents to Canada falls under the regular PGP sponsorship lottery. This is no special program for refugees / protected individuals. You need to wait until you are officially a PR and also meet the income requirements for three years in a row from a job in Canada. You then enter the lottery and hope you are selected. Siblings can only be brough to Canada as dependents in the parent sponsorship application and only as long as they are under 22 years old and single at the time the application is received by IRCC.

He/She will have eligibility interview, and referred case to IRB for Hearing. If outcome is positive, She/He becomes Protected Person

Not necessarily, They will assess if claimant meet conditions to claim Asylum. At Eligibility Interview you don't need a lawyer. Three situation one can fail eligibility, Inadmissibility, Misrepresentation or if there's record of failed refugee claim
3- When can they apply for PR? after eligibility interview?
You apply for PR after Positive Notice of Decision, not at eligibility
4- Is PR application process done online and is same like any other PR application or requires a court presence?
It can be done online or paper based application.You dont need to be present to make submission
5- Can a refugee transfer their eligibility interview from Quebec to Toronto?
No. You can transfer your file after eligibility while waiting for hearing.
6- When can a refugee obtain a travel document? And do they need to first apply to their country's embassy for passport and only if get rejected to apply for TRD?
You can apply after positive notice of decision. Once you file for your asylum, applying or using your country you flee persecution will be considered as reavailment, and Minister will intervene, requesting cessation of your status or if before your hearing, it may guarantee negative decision

You can request after you become permanent resident. You wont be given automatic until you request

I have no idea of Ontario. You are eligible for student loans, provincial medical health coverage. Refugee is expected to work just like others
9- When can a refugee apply for work permit?
On your submission, you will tick Work permit during your eligibility, and you will be sent with the work permit to your mailing address. After it expires, then you need to apply for the extension

Other member @scylla has commented on this. Though you are not specific bringing them as permanent resident or visitor

Go to IRB website. In most situation, Counsel will book an appointment for submission. Im not aware of the online process

1. No after eligible interview you just refugee claimant, you have to wait for the hearing. It takes quite a time, for some ppl more than 2 years. If you are accepted yes you become accepted refugee and you can apply for pr

I thought maybe refugees can sponsor siblings or parents who might also be in danger just like they can their immediate family like spouse or children.

The process is still a bit confusing to me. If you can please explain this as well. The refugee claimant was asked questions/recorded, passport seized, and given a form to appear for eligibility interview. How is an eligibility interview different than that first interview that was done at regular border? What sort of questions are asked.

From what you said I understood, that after this upcoming interview the refugee *claimant* will be interviewed yet again to simply make the same refugee claim and then CBSA sends that file to IRB for decision who will respond with positive hopefully and then the person is a *Protected* person. The protected person then will get another date - this time from IRB - that will be a court date for a hearing to make them *Positive Notice of Decision* (this will take 22 months now per CIC looks like). And after that notice is received / awarded by a judge then the person can apply for PR which I am assuming will take another 2 to 3 years. Am I getting the order and names of these steps right?

P.S. What still confuses me is that if eligibility interview is about making sure the person didn't misrepresent their ID, are not inadmissible, and have affirmed they have not claimed refugee anywhere else are all things that were confirmed at irregular border crossing interview so why do another interview again. What is the first interview called at irregular border crossing done by CBSA if not eligibility.

The short answer is no. That option is limited to immediate family (spouse, children).

If someone is truely a refugee claimant/Asylum seeker fleeing persecution/fear of life from Country of Origin, He wouldn't mind about the timeline as long as he is in safe place in Canada. For someone who has exhausted all Immigration streams and use this process as last option, waiting time may be cruel. So all steps looks correct, except after eligibility interview, next step will be your hearing. after hearing if you got positive decision, next step you can apply for PR
