Im wanting to hire a person from Canada who is a permanent resident but not a citizen. My business is an essential business and she does not have a work visa. Not sure how any of this works. Any help would be greatly appreciated. Hope this is the right section to post this

Whatever passport the person has, you have to apply regulation that applies to that passport. PRs don't enjoy any privileges in US

Suggest you read the following to determine which work permit is appropriate. She will not qualify for a TN since she's not a Canadian citizen.

Most likely you're either looking at an H1B or H2B.

You should also be aware that there are work permit restrictions in place right now due to COVID-19 and there is a freeze on issuing most classes of new work permits until 2021.

Your plans may not be possible this year.

Depending on your specific business type/industry, i would say it might be very difficult to hire a foreign person to work in the US right now due to the tighter restriction. All H1-B, H2-B and L visa issuance are suspended until end of the year.

The bringing in of workers is the problem.

I am not sure if you have been following the news but Trump admin has suspended most work visa processing for all of 2020. The visas most relevant to you i.e. H1B and H2 are suspended for further processing.

Secondly, Canadian PRs do not get any preferential access to the US. Canadian citizens can work in US on TN visa.

In short, 2020 is not a good time for you to apply for a work permit of a worker who is a foreigner.

Getting a U.S. work permit is the problem.

Trump has frozen most work permit categories until next year.
