Hello,

My work permit expired a month ago and I am currently searching for a new employer but it's difficult. I got married recently and my husband filed an application to sponsor me and the whole process I believe takes longer than a year. I'm wondering if I can get a trv/visitor visa so I can stay lawfully in the country, other than a work visa. I'm a citizen of a non-visa exempt country sadly and I wanna bypass flying back home since the economy is bad there and we wouldn't know how to survive there with the little money we got saved.

Is there a chance I could get a refusal for a TRV application?

So you're currently living in Canada now? Is your spouse applying inland or outland? What country are you from?
 
If your current work permit expired a month ago, and your husband has filed an inland sponsorship application this is what I would do.

Send in an application for an OWP to be attached to your sponsorship application. Once it is attached you will have implied status in Canada and won't need anything else to stay. Unless you can find a job that is willing to do LMO, you are best served by NOT working without a valid work permit. This could ruin your chances of getting your PR as it is committing a crime.

If you are absolutely set on getting something to give you status in Canada, you could try to change your current status from work permit to visitors status. I don't know how that would work exactly since your current permit is expired, but I know you can file an application to change your status in Canada. Check out the CIC website to get the correct forms.

You would not need a TRV if you don't leave Canada.

Submitting an OWP app will not give the OP Implied Status. Implied Status can only be gained when the new application is submitted BEFORE expiry of the current status.

As your status expired less than 90 days ago, you can apply for Restoration of Status along with an application to change the conditions of your stay from worker to visitor. Include proof that you have submitted the PR app and proof of money to support your stay (savings or your husband's payslips) and there is a good chance it will be approved.

If that application is approved, you will once again have legal status in Canada.

The other option is to remain illegal and hope that CIC doesn't notice. Be advised that there is always the risk of deportation if you stay illegally.
