Hi,

I’ve applied visitor visa for my brother and his 2 kids who’s married (4 kids) and have an active business which generating handsome income, I’m here from more than 15 years, my mother is PR as well.

Applied online IRCC: July 29
travelling dates were (Aug 6-26)
Office: VFS global Lahore

Biometric expired (didn’t find any appointment, expired BIL, raised webform and got updated BIL in September 21

Biometric appointment: October 3
Biometric completed: October 9
Biometric Validation letter: October 17
Refusal letter: October 17

Refusal reason:
• I am not satisfied that you will leave Canada at the end of your stay as required by
paragraph 179(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/
section-179.html). I am refusing your application because you have not established that you will
leave Canada, based on the following factors:
• The purpose of your visit to Canada is not consistent with a temporary stay given the
details you have provided in your application.

PS: My mother is PR and I’m citizen, is that’s the reason for refusal, also the dates were messed up, they suppose to travel on Aug 6 but biometrics expired and finally got an appointment on October 3, is it the reason for refusal?

Please provide your suggestions?

Why did your brother and kids want to visit? How did you justify the short stay

Highly likely they will overstay and look for PR options is the concern here


PS: My mother is PR and I’m citizen, is that’s the reason for refusal, also the dates were messed up, they suppose to travel on Aug 6 but biometrics expired and finally got an appointment on October 3, is it the reason for refusal?

Please provide your suggestions?

How long a trip did your brother request? What evidence of ties to his home country did he show? How much did he show in proof of funds to support his trip? What was the stated purpose of his trip? Does he have previous travel to countries requiring visas like the US or UK?

How long a trip did your brother request? What evidence of ties to his home country did he show? How much did he show in proof of funds to support his trip? What was the stated purpose of his trip? Does he have previous travel to countries requiring visas like the US or UK?
- Trip requested for 20 days (Aug 6 - 26 )
- sufficient saving and his business income ( no objection about funds in refusal letter)
- Meet me and family during summer vacations for 20 days and my birthday celebration in Aug) but his biometric completed on October 3 :(
- No travel history ( I believe this is not the rejection reason I seen numerous cases with fresh passport to get Canadian visit visa)

If you have no other siblings the fact that your mother got PR and you are a citizen will be a major impact. When did she get PR? Was his savings personal savings or business savings? Business savings will not count. The fact that he has never travelled will be a big factor. What is his country of citizenship? How did you obtain PR? How old are the children travelling with him? How old are the children left behind? What was the reasoning to rebels with half the family an and certain children versus travelling with just your spouse or alone for your first visit? The fact that they applied right before expected travel date would also be a warning sign. Were the travel dates during school holidays? Would suggest ordering GCMS notes.

Yes, it was during summer vacations.
We have other siblings at home country.
- half family visiting (he and 2 kids under 12) rest his wife and 2 kids under 6 are staying home they are too young to travel
- his mostly saving is in personal bank but also showed his business saving ( visa officer didn’t object his financial situation)
- I was SW 16 years ago, I sponsor my mother which is straight forward

I ordered GCMS notes, let’s see next month what’s the main cause.

The factor that your mother and you are are PR, will make his application weak.
He must have very strong ties back in Pakistan otherwise Visa Officer will automatically take it for granted that he will never leave Canada.
