Hi guys - my wife is pregnant and as she previously had miscarriage, we are looking to apply for visitor visa for her sister to assist and take care of her during pregnancy as we don’t have any support here. Or do we apply showing we are doing baby shower and function post delivery? What would be best course of action and best reason so it can be approved?

She’s 38, married for 15 years, has husband, 2 kids (13, and 11 years old), has her house in India, and has a government commodity business which can only be run in India (so no chance of bringing it to Canada).

History: 2018 refusal applied via agent weak file (may not return back, economical factors), and 2022 refusal (applied as whole family for 2 weeks vacation) and I made sure we had all the papers attached for them (3 years of ITRs, incomes, statements, letters from schools that kids study there and are approved to visit), work letters confirming vacation days etc), everything one could think of. We even attached our financials that we can support them and make sure to send them back.

How long is she coming for? How much in funds? Your wife has support and someone to take of for her during the pregnancy...you. Say she is coming to meet niece or nephew. Coming for a baby shower is not really a reason...it is one day.

So she shows at least $10k in personal bank statements above and beyond any cash in the bank to support her family. This is for a 2-3 week visit. Ties to return are business (registration, taxes paid, contracts) and family. Your wife writes letter saying she is coming to meet the newest family member. No mention of help and that her sister can afford to cover all expenses. Highlight her strong travel history to US, UK, NZ or AUS if she has it.

What you seem to be suggesting would be working illegally.

Nnnnmope. What part of this suggests illegal work? Don’t family members or sisters help out in Canada in taking care of their pregnant mother, sister, or someone in family? Or is it always “you’re on your own, find your own help” ? My wife needs emotional support, her traditional foods that her mother had fed the elder daughter during and after pregnancy, so what’s the harm in this? That’s not illegally working by any means.

To IRCC it is. You are her husband and her support. Reword it and say she is coming to meet her niece or nephew for the first time, and staying for 2 weeks. Don't mention taking care of wife, cooking etc. as that is considered work to IRCC.

The family in general not just women do help if possible but primarily the husband’s role to support their spouse in Canada. Husbands can do more of the cooking, cleaning, shopping, help more with childcare if there are other children, etc. if the wife can’t or needs/wants to rest during pregnancy. You were suggesting that your SIL wanted to come due to a previous miscarriage so assume it is relatively early in the pregnancy and not near your wife’s due date. One things to come for a few weeks around the due date for emotional support but what you were insinuating was a longer visit.

Understood. She’s in middle of second trimester. We were hoping to have her here end of 7th or beginning of 8th month. She can only manage to stay for max 1.5-2 months as she has a kids that need their mother for everything from school work to food etc. and she has to attend to her business as well

Would suggest a 2-3 week visit as 1.5-2 month visit weakens ties. Processing from India is around 4 months not including up to 30 days for passport stamping. So not sure she will be in Canada by the birth.

Thank you for the information and we should proceed like that. Do you know how long of Visa durations are they issuing right now? Someone said if people put 2 to 3 weeks, they will only issue for 2 to 3 weeks validity. And if we put one month or two months, they will own the issue for that much validity only. is this true?

Not true. If approved after showing proof of funds, travel history, ties to return and reasons to travel then may get up to 10 years or one time entry. Not heard of people getting a two week visa. Now when you enter Canada, CBSA determines how long you can stay up to 6 months.
