Hello all

My mother came to visit us here in Canada in November 2024. I applied for an extension of stay for her from May 1, 2025 to May 1, 2026 (One year) on April 10, 2025. But we are still waiting for a response. As May 1, 2026 is just one month away, I am confused what to do next.

1. Can she stay past May 1, 2026 if we don’t hear back from IRCC by that date or do we need to submit another extension application before May 1, 2026 as we only asked one year of extension but are still waiting for a response.??

2. Can she leave Canada before a decision is made on her extension application. I have read somewhere that it is not a good idea as her extension application will be then considered abandoned and her her implied status will no be valid then??

3. What to do if she wants to go back to the home country?

Btw, her visitor visa is valid up to April, 2027.

Any insights will be greatly appreciated. Thanks in advance.

1. Yes.
2. Yes. If she leaves her extension is cancelled. A visitor record is just to stay in Canada.
3. She can go back.
Thanks for your prompt reply. Can I please bother you to ask a little more:

1. The “Yes” here means that she can stay past May 1, 2026 and we do not need to submit another extension application until a decision is made on the first one even though we asked for extension up to May 1, 2026 only.

2.&3. If she goes back now without waiting for the decision, will her implied status from May, 2025 up to now be still considered valid??

Thanks again.

1. She can stay if no decision has been made.
2.3 If she leaves then her extension is cancelled because no longer in Canada so no need for an extension. Her status should not considered an overstay. But it seems like she is living in Canada is she came in November 2024. She doesn't want to return for a while

Thanks a lot for the reply. She wants to go back but we are just waiting for a decision on her extension application.

Thanks again though.
