Hello All,

My wife is here on visitor visa and her 6 months stay expires on January 13, 2018. We received the passport request for her PR (spousal sponsorship) on November 28. We sent her passport to Ottawa which reached on December 4. We are still awaiting the stamped passport back. I am not sure if we will get it back or finish landing before Jan 13.

My question is since she has received passport request and passport is sent for stamping do we still need to apply for visitor visa extention as the landing will be done after Jan 13. If yes we are already late for the 30 day time limit..Can we still apply?

The 30 days is a suggestion, not a requirement. You can hold off on until a few days before her status is expiring. If she hasn't recieved her passport and landed by then, you can apply for the extension.

Thank you for your response. Does this mean she is "Required" to file an extension. Is'nt passport request an in principle approval for PR?

Passport request/AIP/COPR issuance/etc. do not grant status. If she remains in Canada beyond Jan 13th without either landing as a PR or applying to extend her status, she will be here illegally. Up to her if she wants to do that.
