I have an old H1B petition which was used for 3 years; then on my extension, there was an denial.
My employer in the US is willing to sponsor me again using the old petition since I come under cap exempt category.
If I had a job and travel to the US using visitor visa, can I internally activate my H1B?. I wish to stay there for an year and then go for stamping. Is this possible?
