Hi all,
My wife and I are just about ready to send off her PR application. Does she receive an automatic extension of her visitor status if we apply for PR, or will we need to apply for another visitor extension? For reference, she's American, and she's received one extension of six months which says "further extensions are conditional on an application for permanent residency".

No. A PR application does not extend her stay.

Unless she submits an Inland application, along with an Open Work Permit (which is NOT recommended since she's an American), she really should just apply to extend her stay online.

Please tell us that she's submitting an Outland application! :o
 
Yes, we are applying outland.

I notice that the current processing time for visitor extensions filed online is 59 days. We're going to be cutting it close as I need to get my Notice of Assessment for this year, and it'll be a few days before I get the code I need to access this. I did notice that visitors applying for extensions have "implied status" while waiting for a decision on a visitor extension. Does this mean that if we apply for the extension and her original extension expires, she's OK while we wait for a decision? Or will she have to leave the day her current extension expires, even if we've applied for another extension and are waiting for their decision? It sounds to me like she'd be allowed to stay pending the decision, but I want to be sure.
 
Why do you need your NOA for this year?

You need to include your Option C, which is not the same as your NOA and needs to be mailed to you by CRA (takes about 10 days, I believe).


yes, if she applies to extend her stay, prior to it expiring, she will be under implied status pending the decision.

I do have another question, which is somewhat unrelated. Right now I'm working a job that lets me meet the minimum necessary income. Unfortunately, there's a chance that I may be downsized out of my job in the next couple of months. I have good prospects to get another job, but it may mean that when they're looking at my application, I may no longer have the same job I stated.

Will it be necessary to find another job where the salary is the MNI, or is it OK because all my tax and income information will show that I met it for the 12 months (more than that actually) preceding the application?

There is no minimum income required for spousal sponsorship. You simply cannot be receiving Social Assistance and need to show CIC how you will be supporting yourselves...that's it!

I can't answer your question about being unemployed when your application is actually opened, but since the Sponsor approval for an Outland applicant is pretty quick (only a few months), you might still be ok [employed].

To reiterate what Ponga said, the Option C cannot be printed off from your online CRA account. You need to actually phone CRA and request one; do this ASAP, as it will take around 10 business days to arrive.
 
You are on implied status as long as you apply for an extension by the last day of the previous visitor record. We sent a couple of them on the very last day. I wouldn't recommend cutting it that close, but I'm pretty sure they actually go by the mailing date if they can read the postmark.

Sometimes they issue a visitor record much faster than the stated times. We've been surprised once of twice to find one in the mail before we expected it.

You should apply for a one-year extension. It is likely that this will be granted. If they want to give you less, they will give you less.

If worse comes to worst, explain that you are waiting for your Option C before sending the application in. It's likely that it will all be sorted out before they look at your extension application, anyway. Be sure to send a copy of the PR fee payment receipt with your extension application. That is good evidence that you have applied or intend to.

It took us 4 years from the fee payment until we actually sent our application in. We had lots of reasons for this. Maybe they are not as lenient now. We never had a condition that further extensions required a PR application to be already submitted, though we did have a requirement for a medical exam at one point.

CIC took my printed "option c" which was really only information from that tax year. We are currently waiting for AOR2 now. I wrote a note indicating saying it was noted in the CRA recording that I could print it from my online account.

An Option C is not an NOA; the Option C show more detailed information, particularly anything to do with social assistance. It is not advisable to send an NOA instead, as it means the app is actually incomplete and could be returned or delayed while the VO requests that an applicant send the Option C.

As with pretty much everything, it comes down to the VO reviewing the file; some might just accept the NOA, some might request the Option C and some might just straight out return the app as incomplete.
 
Well, I just got AOR2, so i dont think they will send the application back. Perhaps will ask for it if needed.
