Yeah, he could try and come back but they might refuse him on the 31st when he lands at Pearson. And probably more likely to do so then if he leaves the 4th, comes back later in January for the trip etc.
 
Provided he has proof of funds, proof of the submitted PR app and proof that he applied for the extension prior to Jan 4th, he should have no issues returning Jan 31st.
 
Even if he stayed on implied status until the 24th? We should have AOR by then.. but what if we don't?
 
I thought if you had a VR and left, the current VR is technically null (even though people often cross on the same VR)? I thought leaving Canada technically resets your status.... depending on how long you were in Canada. So I'm wondering if the VR you have even matters now because he left and returned since then.
 
Leaving only cancels your VR if you surrender it. Ours is still active. We talked to the immigration guys at the border.

Yes. Implied Status is still full legal status.
 
He's just worried because applying for the extension is $100, then if they turn him away on the 31st it's like $700+ for a plane ticket back home. I'd rather he stay until the 24th but he wants to avoid any possible hassle for the 31st.

They won't turn him away. CBSA is very lenient with people who have spousal PR apps submitted. Once he comes back in on the 31st, he can apply for a refund on the extension.

Thanks canuck_in_uk! Welp. Hmm. Does anyone disagree and think he will have trouble coming back in on the 31st? Not saying I don't believe you. Just, yknow. Multiple opinions.
 
Also, if we do the implied status thing, what does he do with the VR when we leave from the airport? I know if he left at the end he's have to turn it in at the border, so how does that work at Pearson/YYZ?
 
I applied past March for a refund after applying for a visitor extension after applying I left Canada and came back putting 180 days on my declaration card flying into YYZ and was let back in. I thought I should try for the refund but I still have never heard back. I've learned through this process you have to have patience and know it's going to cost you money.

I have a 1 year VR which is different than applying for a visitor extension. Since I received my VR I haven't had any issues crossing into the US and back. Maybe it's the crossing I use (Windsor/Detroit tunnel) they have also told me I can extend my VR if need be if I do not receive my COPR in that year. Out of all the border crossings and airport CBSA I've encountered in Ontario the tunnel has been the best.
 
Welp, we decided to apply for the extension, but it won't let us upload the form. Keeps saying it 'fails to validate' when we upload. Like, if we click the validate button on the form, it works, but when we try and upload it it says it fails to validate.
