Hello there and thank you so much in advance for your time and care.

Here is my case and problem:

I have just received a letter (email) refers to my application for a Visitor Record extension and it has been refused. my current visitor visa was expired on March 30 2019 which I applied a few weeks before that asking for another 6 months.

I have been living in Canada for the past 3 years with my spouse who is a canadian, we have been together for 5 years, we are now living together for at least 3, planning a family and working on our common law partnership/sponsorship papers which are almost done (needed to wait for papers from all the places i lived before) every 6 months in the past 3 years i applied for an extension and i got it, this is the first time i got refused and we are worried.

the letter doesn't mention much and i notice many people get the same letter, i do not know what to do now, i have a life here and simply can't see myself leaving, the past year i have done nothing but work on the common law papers and i am almost done and ready to apply but i did not expected this. we are not wealthy so we cant seek legal advice and every little money we can save goes to savings for the common law papers and basic life needs, i am not allowed to work here so we try to keep it very basic.

I am originally from israel but i left 20 years ago, i also have a french passport but i don't really have a home or a place to stay in both places, canada is my home. I don't know if i have to pack or apply again or try applying to the common law sponsorship without a visa, i am a little lost and would love some info.

Any help will be appreciated and thank you again.

You should immediately submit your spousal sponsorship application, pay the full fee, and then apply for restoration of status. Include the receipt of the fee and state that you have applied for PR under the family sponsorship stream.

And don't worry too much. If you follow these steps and the rest of your application is in order (i.e you're not inadmissible for some reason - health, security, etc), it's usually not a big deal. Many people have been in your situation and have received their PR.

You have 90 days from the day your received the refusal to submit your restoration application. So get cracking on submitting that spousal sponsorship.

Massive thanks for you fast and helpful replay, i will try to breath normally now and get cracking on my common law sponsorship papers, then apply and apply for restoration, i felt like the floor has vanished under me while feeling so close to finally applying to be legal with my partner. this is nerve racking but with souls and places like here myself (and i am sure many others) might get a little fresh air and info to continue on own mission.

I Wonder, how come none of these tips are mentioned in the letter of refusal? i find it so odd and daunting, to get a letter like this is no picnic to no one and there is no advance info about contacting (phone or email or office) and getting help nor info about the restoration process and such like a detailed reason for refusal, feels like a generic reply email, i had to google for hours and click links about issue like these, thank god for places like this forum that gives some info to help the clueless. I sure hope in the future the system will adapt since looks like this is a common issue.

The tips aren't mentioned because it's not IRCC's job to tell you how to get a visa extension. If you've been here for three years and haven't put in a PR application, they would doubt that you intend to without proof to the contrary, especially since you've stated that you can't imagine not being in Canada.

Most people intending for PR apply in a matter of months, not years.
 
You’ve been EXTREMELY fortunate to have been given three years, you’ve been effectively living here,versus visiting . And blunt as it may seem, it’s not Canada’s issue that you hold a French passport and have no where to live there if you have to go back
If you’ve been gathering all your proof for your application over the past three years , one should assume you won’t have a problem then
