Hi everyone,

My mother is currently on implied status since I applied for a visitor record before her 6 months stay expired.
The application has been in progress and is still pending. However, she has now decided she wants to leave Canada within the next week.

I'm wondering what I should do with her pending visitor record application. Should I withdraw it before she leaves, or can I just let it remain in process?
Will her departure automatically affect the application, or could leaving while it's still pending cause any issues with future entries to Canada?

Any insight or experience with this situation would be very much appreciated!

You can’t withdraw since she would then have been in Canada without status. Send a webform to IRCC informing them she has left and the date. She still may receive a request to do a medical and she must do it if she receives one because she benefitted from visiting Canada longer on implied status. If she gets a medical request and doesn’t do it she will have difficulty visiting Canada in the future.

Just a couple of follow-up questions:
  1. If IRCC requests a medical exam after she has left Canada, would she need to complete it before she can use her existing multiple-entry visa to return? Her multi-entry visa is still valid for another few years.
  2. So, would you say the best approach is to wait until she has left Canada, then submit a webform to notify IRCC of her departure and then simply leave her visitor record application in process until IRCC makes a decision/responds to the webform?

1. She would have to complete the medical soon after receiving the request if she gets one. Yes it could be an issues for reentry for another visit or when she applied for a new TRV. She has benefitted from the extra time in Canada so although it seems backwards a medical request would be part of the ability to visit for longer.
