Hello everyone,

My wife is pregnant, and I had applied for a visit visa for my sister-in-law so she could come here and support my wife for about 4 months. However, the application was rejected despite all the documents being complete, including the invitation, doctor’s note, financials, and proof of home ties. I had selected the option that she wanted to come here because medical support was needed. Did I choose the wrong option? Please let me know if I should select the correct option and reapply or request reconsideration. Below are the reasons for the refusal:

I have reviewed your temporary resident visa (visitor visa) application and supporting documentation to assess whether you meet the requirements for a visitor visa (https://www.canada.ca/en/immigration-refugees-citizenship/services/visit-canada/eligibility.html). This includes assessing whether you are coming to Canada temporarily for the reason(s) you describe in your application.

I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) (https://laws-lois.justice.gc.ca/eng/acts/I-2.5/index.html) and Immigration and Refugee Protection Regulations (IRPR) (https://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/index.html). I am refusing your application.

• I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 179(b) of the IRPR (https://laws-lois.justice.gc.ca/eng/regulations/SOR-2002-227/section-179.html).
I am refusing your application because you have not established that you will leave Canada, based on the following factors:
• You do not have significant family ties outside Canada.

• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application

Medical support isn't really a good option for pregnancy. Medical support is typically for situations where someone has a medical emergency or serious surgery and needs support from a family member. I would have simply picked visiting family.

Four months is a long visit. How much did she show in proof of funds and what ties to her home county did she show? Does she have previous travel to counties requiring visas?

Did you indicate that she would be helping to take care of your wife or the new child? That can also be problematic sometimes.

I thought there would be medical support, which is why selected it. Showed around 26K CAD funds, and there is no previous travel history. This is the first time she's traveling outside the country. Mentioned her parents and family members in the family ties section, and had shown my university enrollment letter. Additionally, mentioned my wife’s pregnancy and the newborn in the application.

So now, how should I deal with this now? should I contact the processing office for reconsideration, or do I need to apply again by selecting family/sibling visit with a new invitation letter and new reasons for visiting?

IMO you should reapply and shorten the visit to one month or three weeks and also change the purpose.

No travel history makes her profile weaker and family won't be considered as a tie unless it's a spouse or children.

In addition to the school enrollment letter she should show evidence she has paid her tuition for the next semester.

That's my two cents.

Is the 26k all her funds?
I will submit a new application then, and mention a 2 to 3 weeks visit duration.

Also, since she hasn’t gotten married and has no travel history, I didn’t add anything extra about that.

I’ll add the school fee receipt and mention that she had around 8K CAD funds. For the rest, I mentioned that I will be supporting her in the additional information section
 
Funds: Is the $26k in cash in her name only? Her funds are the only important banks statements. IRCC doesn’t need to consider any other bank statements.
Ties to return: If single then she needs to prove that she will return. So include school receipts and proof of registration.

Is this first refusal because IRCC has past documentation and if she showed that she was coming for 4 months for a medical reason then approval will be more a challenge.
