Dear All,

I need your sincere advice. Please read this thread completely.

I am from Pakistan. I got married in 2009 and after six months, my husband went to Canada (novascotia) on student visa (for MSc). Our daughter got birth in 2010. He came back to Pakistan in 2012.
In 2013, our son got birth. My husband went to Canada again in 2013 (for PHd). He divorced me in April, 2014. I am living with my parents along with my daughter and son till now. In 2016, he got married again.
Now He has gotten PR recently (July 2022). His wife was the main applicant. He wants to sponsor our children for PR.

My question is: Can I go with my children as well? I talked to my es-husband. He said that first children will get PR than they can sponsor you and to get PR for children, they must be entered in Canada lonely. I am afraid to send my children to Canada. As a mother, I cannot take risk to send them without me.

Is there any method that I could come with my children?

Should I hire a lawyer (in Canada)?

Please suggest me what to do?

The children would have had to be included in his new spouse’s PR application which would include your ex husband and your children as non accompanying. Your children would have had medicals at that time. Did they? If they were not included in application, he can’t ever sponsor them for PR as he misrepresented himself on the application.

As for you, your children cannot sponsor you for PR until they are over 18, meeting a specific level of income for 3 years and then are selected in the lottery. So you either have to get PR through your own merits - education, age, language and skilled work experience. You can come as a visitor up to 6 months but can’t live or work in Canada.

To come as a visitor, you must show funds for your visit, travel history, ties to home country (job with approved leave, business, maintenance of properties) and reason to visit.
