Hi there,

So I have a question. My Dad is here on a multiple entry valid for 10 years. He is visiting me since 2013, applied for his extension everytime he is here. He had 3 trips going back home with 1 year stay there before coming back here in Canada.

His recent entry was Feb2019 so I applied for his extension Jul2019. It came back refused Sep2019 and I applied for his visitor record restoration Oct2019. We just got the result Feb01 and his restoration is denied. He must leave Canada immediately as per the email.

My question is, how immediately is immediately?

I have booked his flight to go back on Feb09 because I was so scared an IO will knock on our doors and take him to the airport, and then I read something about the possibility of staying for “30days”?

I have a scheduled CS for my 3rd baby on Feb18. Can I rebook his flight on Feb23 (that is still within 30 days since we were informed of his restoration refusal) so he can stay a little bit and see my kid before flying home?

Please advice, thank you so much!

He seems to be spending more time in Canada than at home which seems to be the issue. Not sure if he is also watching your children. That could be the other issue. He hasn’t had status since the summer so immediately does mean ASAP. It is up to you to determine if you want to push the envelope and rebook his flight. It could have an impact on any future visa/extensions. He should plan on not returning to Canada for the next year.
 
HI there - for the sake of argument lets say that your father was arrested and detained for being in Canada without status after having been told in writing to depart immediately.

If you wanted him released immediately, would you mean a few weeks from now?
