Visa refused Second time - Abudhabi VFS

I am an Indian, living in the UAE since my school days. I have been rejected my student visa two times. Applied from the United Arab Emirates(Abudhabi VFS). I have applied for an MBA from the University of ****

NON-SDS
1st refusal: 2nd December 2020
2nd refusal: 8th February 2021

Background:
Completed BS Hons(International Business and Economics) 3.68GPA out of 4. Studied at an American University in UAE.

IELTS: Since my previous study was in English, I got a language proficiency letter from my previous university and My MBA University waived off the IELTS requirement.

Work Experience: My dad has been running a business In the UAE for the last 17 years, and since my completion of studies, I work for him as a Marketing Manager(4 years to be precise).

Finance: I have taken an education loan from India to fund my studies and living cost. I didn’t show any liquid saving money. Since mine is a family business, I don’t take much salary and every income from business goes to my home itself. I have paid 11K CAD as the first module fees.

Things that I have attached with the visa file: Statement of Explanation, Admission Offer letter and education credentials, IELTS waive off letter, proof of fund(Education loan from India), father’s business bank statement in UAE(Yearly turn over of around 300K CAD), letter of employment in UAE, trade license, UAE business TAX returns, India Asset Valuation by Chartered Accountant, Property Tax India, salary certificate and statement.

I applied both the time myself without involving any agent.

After the first refusal, I didn’t apply for GCMS and straightaway applied for a visa again since my classes were starting in Jan'21. I understand that was a mistake. However, after the second refusal, I applied for GCMS notes, and this is what it says. I spoke to a lawyer and he said my case is complicated and it’s like 50-50 chance.

What should I do? Should I quit my Canada study plan, try some other country, or give it one more try? Expecting some valuable feedback. Thanks in Advance.

GCMS Notes says:

Iam not satisfied that the cost and difficulty of studying in Canada are commensurate with the stated benefit.

1. I am not satisfied that the applicant would leave Canada at the end of the stay as a temporary resident, I note that-

-the client is single, mobile, is not well established and has no dependants.


2. The study plan does not appear reasonable given the applicant's employment and education history. I note that: -the client's proposed studies are not reasonable given their career path.


3. Taking the applicant's current employment situation into consideration, the employment does not demonstrate that the applicant is sufficiently well established that the applicant would leave Canada, at the end of a period of authorized stay.


4. The applicant's immigration status in their country of residence is temporary, which reduces their ties to that country.

Weighing the factors in this application, I am not satisfied that the applicant will depart Canada at the end of the period authorized for their stay.

2. Seems the VO doubt you will be able to cope with difficulty of study - what are your grades for your undergraduate? Also not submitting an English proficiency might not have helped your case, especially if the grammar in your SOP was not up to par.

3. Not well established - Did you properly explain why you are studying an MBA? What will be the benefit of the MBA to your career, seeing as you experience has so far been in marketing?

4. Did you show you intend to pay off your study loan, seeing as you didn't show any proof of money in your account?

5. You xxx'ed out the name of your uni. Why?Perhaps you should share it as this might also be a factor especiallyf or MBA. VOs are aware that some schools (esp private Unis) are just degree mills and their MBA offering has no pedigree.

These are all I can think of for now.

Single 27 year old with 4 years work experience, you should show some savings in your own account, as well as proof of earnings. Just because it's a family business doesn't mean you shouldn't be getting paid. Not showing personal financial capacity is a HUGE red flag.

How does an MBA help you achieve your future goal? is the MBA specialised or general? With that you intend to do, I'm not sure a general MBA makes career sense.

Your intended university is fine. I suggest you get the GCMS note for this refusal as well and take if from there.

The visa officer doubt that you will leave Canada after your stay. Your application file indicates that to the visa officer as pointed out in the gcms notes.

therefore the reason for your study permit application is not to study but to immigrate and stay in Canada.

Plus the fact the you have no money to study and support yourself in Canada.

Overall your profile is decent but there are few red flags which makes it complicated. I would advise as follows:-

1) Take IELTS, it is not that difficult to score overall 6.5 with little preparation if you already have good command over the language.
2) Show funds in your account, being 27 years old with no liquid cash definitely hampers your profile. I know you are a part of family business but for VO they need tangible evidence of you having ownership of that money irrespective they are your parents.
3) What reasons have you provided for doing an MBA from Canada when you already have many options to do it from UAE. There is even a Canadian university in UAE if you feel Canadian education is what you are after ? You need to ensure these are answered with clear plan.
3) Do you or your family have any assets in India? if yes, apply from India. Do your parents have any plan to settle in India after UAE ? If yes, add this to the SOP and state you will return to India instead of UAE. Show as much ties as possible based on your passport.

Firstly You got to provide a convincing answer for all the above-mentioned points by the visa officer, reframe your SOP and submit a stronger SOP. Take experts advice if required. Strong family tie-ups in the country of Residence & Home Country to be provided. Your profile is not so complicated, i am sure if you work on your SOP you can get it approved on your third approach.
