Hello Everyone,

I am looking for some help on my profile from some of the experienced members on this forum.

I graduated from University with a 3-Year Open Work Permit. I was employed in October 2018 but then I was transferred to a better position (both skilled) to a different company but it is owned by the same person who owns the first one.

I was transferred to the new company in February 2019 so in a way, I have not yet completed my 1 year with this employer in order to receive 50 Points for valid offer. I am not sure if the questions I have answered are correct as I have technically worked for the same employer for over a year now and will continue to do so, so i should be receiving the points? I am not sure if my answers are correct. Please advise!

Any help is greatly appreciated.

You should answer No to the first question
You don't have a valid job offer because you don't have a positive LMIA

Okay. That’s fair. what about the fact that I’ve worked for the company for less than a year but technically since it’s the same employer, is it something I could add in my Letter of Explanation? Or should I answer ‘No’ to that?

It doesn't matter how long you worked for the company. It's not a valid job offer.
But wait. that doesn’t make much sense. Apparently, IRCC agents confirmed that since it’s an Open Work Permit, I don’t need an LMIA as the permit will still be valid for another year and I’ll be working on that.
