Hi guys,

I am currently in Canada on a valid post graduation work permit, which I got after completing my post secondary education from a public university in Canada.

In the past 12 months, I have applied for immigration (CIC) twice under the Federal Skilled worker program, which requires that applicant must atleast have worked for one full year and this work experience must be described by an NOC code included in the Ministry approved list of NOC codes. My application was rejected on both the occasions in the preliminary stage itself.

Immigration reply on both occasions, stated that the code I used to describe my work experience and my title was not included in the approved list of codes. The approved list is given in the Canada gazette.

My work experience which meets other CIC requirements, was best described by NOC code 2144 (Geological Engineer), which is in the approved list of NOC codes. Canada Gazette confirms that. I also got confirmation from NOC that the title I was using was a part of this code, and yet immigration does not seem to recognize such a simple issue. They are saying that a code is not a part of their approved list, whereas it is obvious that it is !!!!!

Now , how should I prove this to immigration and what documents I should I use? Should I use the NOC reply letter to put my case.
Any suggestions please ?????

- If you have worked in Canada for one year on any position OR
- If you have study in Canada for one year or more

then you can apply even if you are not in NOC list

check the following;

There are three categories under the Federal Skilled Worker Class:

Category 1: For persons in an occupation which corresponds to the list of occupations identified in the Ministerial Instructions and have evidence of one year of continuous full-time (or full-time equivalent) experience in that occupation;
Category 2: For persons who have arranged employment offer with a Canadian employer; or
Category 3: For students or workers who are legally residing in Canada, and have done so for at least 12 months immediately before submitting their application.

How long is your work permit valid for? As the above user mentioned category 3 suits your current status.
if you complete 1 year under your work permit, you can qualify to apply under the Skilled category if you can get a permanent job offer from your employer or the job is confirmed by Service Canada (Arranged employment/ LMO)
 
Thank you both for replies. I have some more questions based on your reply.

(1) I finished grad school in May 09 and got the post grad permit in August 09. Its valid till August 2012. Is the immigration looking for one year continuous full time work experience when applying in category 3 ?

(2) Also, if I apply now under category 3 in FSW class, can i cite my study at a canadian university from 2005-2009?
That way as you say, I dont need to be in NOC.

You can do 2 things:

1st - You can wait till August, as to get a full 1 year experience and then apply under category 3

2nd option - you can ask ur employer to do an arranged employment application with service canada; it basically states that you indeterminate job position in the company and it does support immigration applications. You can then claim points for arranged employment.

I would suggest you ask your employer to apply for arranged employment and then use the initial job offer letter, a current work exp. letter stating the term you worked so far and the confirmed arranged employment confirmation from service canada. This will take care of your work experience part in the PR application.
