Hi ,

I am interested to know DO USCIS and CIC share things.
Do CIC will be able to know If some one have fraud in their (USCIS) immigration record ?
A guy married to US citizen for immigration benefits. After , few month she came to know he marry her for immigration benefits. She left him and report about him to USCIS. He did not charged with marriage fraud. They been married only 4 months. Now , he is going to marry some one in Canada. So , Can CIC will be able to ask USCIS about his history?

Part of the process of obatining PR is providing a detailed background history and supplementary evidence. Even if the person did not disclose the previous marriage etc it will be very tricky to put together a solid application. If he has resided in the US for more than 6 months he will also need to submit an FBI check so if he was charged for any offence it should show up on that.

immigration fraud isn't necessarily on the FBI record, it's only criminal offenses. immigration fraud isn't a criminal offense.

yes, the us and canada share information. whether CIC will find this information out while doing their background checks is impossible to say. if the guy is legally married to a us citizen, then married a canadian without getting a divorce, then the second marriage is not legal, and they will not be approved for spousal sponsorship as a married couple. if there is concern about the applicant, then it's possible to report it to CIC so there is a note in a file somewhere. that can prompt cic to do further investigation if there is something sketchy in their file. IF you are a friend of the sponsor, then i would also recommend showing her information to prove his intentions are not real so she does not move forward with the application.
 
That makes sense now I think about it. I know in the UK they have busted a few sham marriage ceremonies recently and those people have been charged and prosecuted but thats not the case here.
 
Thanks for replies. No he is divorced legally. But , there is report about him.
His ex report to USCIS.... Can that report affect his current marriage with Canadian citizen.

The US and Canadian governments share A LOT of information. Sometimes too much (see FATCA).

So yes, CIC can access the information. It really is just a question of if they decide to make the request for it.
