Hi,

I am have strange issue. CIC is asking for clarrification as why i did not mention the USA visa refusal i got. However, I never applied for USA visa so far. What can i do to prove this to CIC?

Are you 100% positive you didn't apply? Might be visitor visa refusal too. If you are so sure I think you can probably write a LOE and submit. Hold on for more senior members comments though.

This could happen when the name, father's name and date of birth matches and US info says the visa was refused. You can prove by sending the expired passports, and explaining them that this has never happened, and there could be some misinformation. You can state all the passports that you have had, their passport number, expiry dates and their bio scanned pages for their reference, stating that this is not true and must be cross checked as you declare that you have never ever applied for US visa and the information CIC has received is incorrect !

How long after your AOR did you get that ?

Does USA always stamps the visa when they reject the visa, or can they return the passport without stamping it?

Just provide a scan of all your previous passports along with an affirmation that you had never applied for a US visa, that this must be a name mix up.

Could your parents have done so when you were a minor?

Agreed this is an important question. We've seen a number of cases on this forum where people weren't aware that their parents had applied for a visa for the entire family and that visa had been refused.

Yes for some cases. My friend got her passport stamped when her US working visa was refused. She confessed her US visa refusal on her PR application and she landed without any problem.
