All insight is appreciated. ;D

I have a lifetime restraining order granted by the state of NJ against a pretty serious stalker covering me, my husband and it even extends to cover both families (parents, siblings). When I move around the US I have to submit the documents to local authorities, so they have the restraining order on file, incase there is an issue.

When I move back to Canada, would this work the same? I see they issue Peace orders which last a max of 1 yr. Nothing to the magnitude of my order.

My question is: should I also submit a copy of the restraining order to CBSA and local authorities, since he is an American citizen and can cross a borer anytime? Or just with the local authorities? Has anyone gone through or dealt with this sort of issue. I Googled so much today but I'm not finding answers to situations similar to mine and would appreciate all and any help.

I don't know but I would try contacting CBSA and the RCMP or police departments of where you are visiting and see if they can help you.

Your request is very specific.

Yeah, I think you're right. It's a very tough situation. Thank you for taking the time :)

A restraining order from the US will not carry over into Canada. Canada and the US are two separate countries with two separate legal systems. If you want to put a restraining order in place in Canada, you will have to go through the full legal process of obtaining one.

You should definitely still speak with authorities in Canada to understand what you should do in your case (i.e. how to put this protection in place if you need it in Canada, what the process will be, and how long it will take).

However I'm confused why you think that a restraining order put in place by one country would be applicable in another country.

Canada and the US help support one another when it comes to criminal situations, which is why I have a little hope it will be upheld. Most restraining orders are issued for 6-12 months. The state of NJ deemed this man to be of such danger they offered protection for a lifetime, not only for me, but my husbands family and my family.

I just sent an email the RCMP in BC laying out the details. Hopefully they will be able to provide me a little better insight. I'll post once I hear back what their advice is in this situation.

So the RCMP replied, it appears Canada does uphold restraining orders issued in the US. It seems to be the same in the US, contact the local authorities:

Hi XXXXXX,

Police in Canada enforce or
acknowledge legal documents; however I hesitate to provide you guidance
in this area as we are not aware of the nature of your order and any
limitations. Enquiry about the endorsement of your order via a
provincial authority.

Thanks
