I have a kind of weird situation that needs your valuable insights:

I came to Canada on PR in May 2018. My cousin applied for my mother's visitors visa in Apr 2018 and she got a multi-entry visa till 2025. She came to Canada in Aug 2018. So, her first entry was valid till Mar 2019. Mom first stayed at my cousin's place and then shifted with me in Nov 2018. In Feb 2019, I applied for her visa extension, as we started looking for an alliance for me. Now, her visa extension ends in Aug 2019. But we are still meeting families. It is hard to say if anything might get finalized before her visa record expiry in Aug 2019.

So, my questions are:

1. Both my mother and I have valid U.S. visitors visa. I also have friends in U.S. So, if she goes to U.S. for a few days before her visa record expiry in Aug next month for about 2 weeks and returns to Canada sometime in Sep, will she have any issue at the immigration counter? Won't this be considered a new entry to Canada? Remember, her original visitors visa was applied by my cousin. I have only applied once so far...that too for an extension.

2. I plan to apply for her supervisa next year once I meet the income criteria this year. As mentioned above, if she returns to Canada in Sep this year after travelling to U.S. for 2 weeks between Aug and Sep, will her file be affected in any way next year during her supervisa application? Please note: if she returns to Canada in Sep, she will only be here for 3-4 months, say till Dec-Jan. We have a family wedding for which she has to travel to India around Jan 2020. I too will be travelling to India in Apr 2020. She will only return to Canada in Jun/ Jul 2020 if she gets a supervisa and if my marriage alliance thing is not fixed by then. Her presence will be required to continue looking for an alliance here along with me.

It would be highly appreciated if someone can spare time and respond to this post basis experience and expertise.

Others will comment as well but as she has been in the country since August 2018 with one extension then first thing that comes to mind if she leaves the country for a couple of weeks July/August and attempts to come back in then CBSA May think she is trying to live in Canada and is no longer a genuine visitor. Do not think who invited whom would be relevant given she is responsible for her status in the country not the sponsor and being a visitor for a year already might be a hard sell.

There is no way to predict of course but seems a better option might still be to apply for another extension given she can stay put in Canada pending a decision and it might take a few months for that decision.

General advice on here when someone has a multi entry is to be out of the country for similar time as spent in the country so you get how this might play out in her case.

A super visa application would be a completely separate item from any previous TRV applications.

A few questions:

1. What are the chances of the 2nd extension?

2. Will the 2nd extension have any effect on her supervisa? Don't they look into complete previous travel and stay history before approving a supervisa? I know for supervisa, the most important criteria is the income one, which I will definitely meet. But will her stay between Aug 2018 and till whenever she is here, have no impact on supervisa?

Another thing: A friend of mine who came to Canada on a student Visa about 4-5 years ago is now a PR. Her mom visited her about a year ago. She first got her mom's visitors, then extension..and finally during her extension period itself, applied for her supervisa, which even got approved. Till this time, I knew supervisa has to be applied from home country, but in her mom's case, she got it while in Canada on her extension period.

Another quick question- what are the chances of my mom getting another extension if I proceed? In this case, she won't visit U.S. I will just apply for her 2nd extension...given the fact that it will be 1 year of her stay in Canada in September. And then, she will return to India by Dec-Jan due to the family wedding. Post that, in Jun-Jul, I will apply for her supervisa and if she gets it, she will travel to Canada again.

It's really impossible for any of us to tell you what the chances are. The first extension is typically easier to get. Once you are requesting a second extension, it becomes more difficult given how long the person has been in Canada as a visitor. If she is able to obtain another extension and then leaves in Dec-Jan, I would recommend waiting 8 months before applying for a super visa.

Interim visit to the US is a much riskier option with lower chances of success.
